    Foia fbi and cbp show no records

    HELLO,

    I am an american citizen and i am planning to request my husband who is from mexico, when he EWI he was caught once, fingerprinted and released withing the same hour when he was caught. This happened in 2007, i requested FOIA records with fingerprints for the FBI and just a FOIA with CBP which both came back with no records found. What exactly does this mean? When filling out form I-130 what should the answer be when asked if the beneficiary has ever been in immigration proceedings?? Thank you in advance for your responses.

    Does anyone know a lawyer who offers free consultation who specialize in understanding FOIA and FBI finger print results. Im tired of getting a I'm not sure, I don't know answers from lawyers

    You can submit a FOIA request yourself online. We paid a lawyer too much money to do it for us with FBI, DHS and USCIS and they all came back stating no records found, we included fingerprints also. Someone on this website suggested I submit one myself online with CBP. It was easy, no fingerprints, no cost and we got his record within 3 months. Go to foiaonline.regulations.gov and select make a foia request, then create an account. It is helpful to add where they were caught and a date if know. My husband wasn't sure so we just did a date range.

    The result you received means they did not find any records, which is the same results we received the first time, but we know there is obviously a record since they were caught and fingerprinted. So this means you need to make another request if you really want to find his records. What I was explaining is that you can make the request yourself and just make sure you provide as much detail as possible regarding the date and where he was caught.

    Again it is always best to tell the truth. For example, you go and can be hit with a misrep charge and might need a waiver for the misrep charge. But feel free to approach it how you want.
