    Son failed medical examination due to use of controlled substances- what's next?

    Hi everyone,

    I am a USC and petitioned for my husband's 15 year old son for US residence. He went to the appointment in Juarez in March of 2017 but unfortunately failed the medical exam due to the use of controlled substances. He was given a inegibility 1A4 (212(a)(1)(A)(iv) which indicates that he can get a new exam on March 27, 2018 to show that he is no longer using drugs. After months of trying to reach someone at the US consulate to set up a new appointment, they informed me that he will not get a new appointment. According to them, he is to go to get this medical examination re-done on March 27th and that he would receive instructions at that time. Has anyone gone through this? I am worried that we are going to go to Juarez next year to get the medical exam re-done and then we are going to have to wait more time to schedule another appointment. Does anyone know if a new appointment has to be scheduled prior to having the exam again?

    Any help would be greatly appreciated. Thank you!

    May 2009 - Left for Mexico on emergency -tried crossing illegally, was apprehended, detained, and deported 30 days later - 5 year ban
    June 2010 - Married in Costa Rica
    April 2011 - I-130 Approved after an interview with INS
    Dec 2011 - Visa interview - Visa denied (as expected) eligible for waiver
    Feb 2012 - Applied for waiver and DENIED in August 2012 - Appeal filed with lawyer
    Nov 2012 - Waiver APPROVED!!!!: Approval dated 11/8/2012 but had incorrect MEP case number. Had to get it corrected!!
    Jan 9, 20013 - Received IL letter and scheduled follow up interview for Jan 23, 2013
    Jan 21, 2013 - New Medical completed
    Jan 23, 2012 - Follow up interview and he was APPROVED
    Jan 25, 2013 -Visa in Hands!
    Jan 26, 2013 - Hubby home!

    He will need the letter that states he is up for medical and your step son should start doing some kind of rehabilitation showing that he is getting his act together. Especially at 15 and failing his medical for a control substance.

    Thank you, he has tested negative on all the drug tests he has received from a doctor/clinic. So do you know what happens once he shows up with the letter to his new medical exam and proof of the negative tests for one year?

    I think Alonso was referring to the ongoing treatment not just testing, presumably you have something lined up for him to continue with when he gets to the US, I would also mention that.
    Nothing in life is guaranteed, especially anything to do with Immigration.

    Oh absolutely! I do have a psychologist lined up for him as he will need more than drug rehab. Thank you!
