    10 Year ban nearly finished, then what do I do!?

    Hello,

    My ten year ban is up in October, thank goodness, and now I am wondering what my next options could be. I have looked in the forums for information and from what I can gather being able to obtain a tourist visa will be extremely hard.

    A summary of my deportation is:

    October 2007 deported back to the UK for overstaying VWP by a matter of days.
    My Fiancee, USC, and I decided to live apart due to her family commitments in the US, we are still together and met numerous times in Canada and the UK.
    We decided against the waiver due to paperwork/cost/hardship.
    I sold my house last year and recently left my employment and have been counting down the days till the ban is over, therefore proving ties to the UK will be hard to show as I do not have any.

    I feel my two options are for my Fiancee and I to marry outside of the US and petition for a spouse visa to return. Or to petition for a Fiance visa to be able to come back to the US and marry there. I feel the tentative third option would be to get a tourist visa to come back and visit while the spouse/fiance paperwork is going through.

    If anyone has information or gone through this process then I would appreciate any help. I wish it were as simple to be able to just hop on a flight once ten years is up and enter the US.

    Visitor visa would be challenging given the immigrant intent and lack of ties.

    K1 or CR1 seems the way to go, assuming you are looking at moving to the US.
    Nothing in life is guaranteed, especially anything to do with Immigration.

    Hi,

    Thanks both for your replies, it really helps and narrows down what we need to do. Yes I am intending on moving to the US permanently and ideally going back to see my fiancee's family ASAP. Once my ban is up in 65 days (not as if I am counting down!) it sounds like it will be hard to gain a visitor visa through the VWP. Has anyone else has this predicament where then ban is up but they are still unable to visit the US? Should we not apply for the K1 or CR1 until I have visited and returned to the UK?

    The eligibility criteria of a visa must be met. If the ban is over then it is over. Prior immigration violations, however, might make a CO to scrutinize the application more. Just make sure you are adequately prepared for the type of visa being applied.

    Did you move from UK to somewhere else?

    You are not eligible for the VWP, those days are long gone.
    Nothing in life is guaranteed, especially anything to do with Immigration.
