    Deportation Error

    Hello,

    i want hear your guys opinion:

    I arrived in the US on a B2 Visa etc overstayed got deported.

    They deported me as "Visa-Waiver" (EU Country), even though i arrived on a B2 Visa, which would have given me a court date at least.

    I requested my FOI File and it says at the POE i was processed as Visa Waiver but they also made multiple pictures of my approved Visa, my Visa application (the B2) etc, my approved Drivers License (expired, but shows also the same like my I-94, authorized stay for 6 month, so DL expired after 6 month arrival).


    I dont have really the money for a lawyer, i asked one and he see's a chance that he can talk ICE to reverse that decision and maybe get me my court date.

    Right now i just dont have the money to pay a lawyer.

    I have an approved I-130 btw, but far away from finish.

    If you want to go to court you need a LAwyer anyway, what would be the point?
    Nothing in life is guaranteed, especially anything to do with Immigration.

    after deportation i relocated to mexico so that doesn't apply to me

    I'm not sure what the point is though. Even if you could get your day in immigration court, what relief from removal would you be eligible for? You said "I have an approved I-130 btw, but far away from finish" which suggests an immigrant visa was not immediately available to you (ie you're not in the category of an immediate relative", so you would not have been eligible for adjustment of status as a form of relief

    The result would be the same - removal
