    Unhappy Waiver on 20 year ban or NACARA

    My fiance is from ES and has been deported 3 times. He applied for asylum in 1989 and was never approved and ended up getting deported back. I think this would make him eligible for NACARA although the lawyer, who I think doesn't know what he is doing, says that he would not be able to have his deportation case opened back up, etc. I am thinking he can.. anyone with experience in getting NACARA recently and with multiple deportations? Also, he received a 20 year ban. I am not sure if this is still considered a permanent ban, but hoping not... Anyone know of any waivers being approved with a 20 year ban? We have a young son together who has many health issues and I am struggling to care for him on my own, so we definitely have the hardship part down, just not willing to throw all that money away if we don't have a chance. But if there's a slight chance maybe we will.

    11/22/11 - Visa Interview
    04/16/12 - Expedite request submiited, approved 2 days later
    05/17/12 - Waiver approved!!! (6 months)

    He first came in November 1989. he was 18 years old. He was deported in January 1995. Came back illegally in 97. was deported again in 03, i am not sure the month on that one. And then he came back in November 2009 i don't know the month either and he is not able to be contacted at the moment for that information. I know he has a valid passport so maybe he did have a Visa? I should have asked him that, but I don't know.
