    Wink Special Immigrant Visa (SIV)

The Defense Authorization Act for Fiscal Year 2008, Public Law 110-181, was signed into law on January 28, 2008. Section 1244 of this legislation, entitled “Special Immigrant Status for Certain Iraqis”, as amended by section 1 of Public Law 110-242 enacted on June 3, 2008, authorizes 5,000 special immigrant visas annually for Iraqi employees and contractors for fiscal years 2008 through 2012. This provision creates a new category of special immigrant visa (SIV) for Iraqi nationals who have provided faithful and valuable service to the U.S. Government (USG), while employed by or on behalf of the U.S. government in Iraq, for not less than one year after March 20, 2003, and who have experienced or are experiencing an ongoing serious threat as a consequence of that employment. In addition to these Frequently Asked Questions for Applicants, also see the USCIS Fact Sheet on Iraqi Special Immigrant Visas.

    my story

Actually no body can say any thing ,except appreciation to USA government for that legislation which safe lot of souls, but
From that forum I entreat US honorable government and official people at national visa center to ease the procedures in these department, especially for those brave Iraqis provide support to the American troops.
I want to talk about my case now ,I am living in other country than my original country cause of armed militia threat under cruel circumstances since 2 years ago.
I have started my SIV visa application process more than one year ago.
1-I have obtained(com)chief of mission approval(USA ambassador in Iraq)
2- I have obtained USCIS approval (petition I-360)
3-My file now in national visa center I already sent them ( Iraqi G passport -Iraqi citizen ship certificate - Iraqi identification card -conduct certificate from hosted country-photograph according required-full English translation for all documents not in English-all required forms DS-230,DS-234,DS-157 )
Last time they contact me they sent me check list asking me to send birth certificate.
How can I provide this document if I am in foreign country and issuance such these document need attending personally to civil department,I tried to contact embassy in hosted country
to ask them assistance useless every time they give different apologize (ambassador is sick -consul just delivered a baby -today is day off ......a.t.c
I have have explained all these circumstance to national visa center and I did nor have any response about that issue
I and my family members suffering cruel circumstances in hosted country enough to say both of my sons use same books at school (books for one student use by two)
And you can imagine the situation.
    thank you

Which embassy did you try to contact?

Have you emailed the NVC or have you contacted them by phone? Either way, were you able to contact someone in the SIV division? Here is an email address for the SIV translator. They may be able to help you with the birth certificate issue.: SIVTranslator.NSC@dhs.gov

The birth certificate situation may be tricky. If there is no birth certificate available, you cannot obtain one from relatives, etc, you may have to obtain some sort of affidavit stating that there is no birth certificate, but this may have to come from your original local government. I'm not sure how to go about obtaining that sort of information though. Hopefully someone else can give you some ideas.

If the embassy does not accept the affidavit by the Iraqi embassy, I am not sure what else they would need, but you will receive something called a "request for evidence" if this happens. They may give you more detailed information in the RFE as to what they will accept. Your case will not be sent to the embassy for your interview until your case closes at the NVC (most likely).

I'm not sure about the DS-260. It is relatively new and I believe it is only available online. Hopefully someone who has had the opportunity to complete this can help more.

The only information on the DOS site is that you should have the invoice ID # in a message you received from the NVC. http://travel.state.gov/visa/immigra...info_5164.html

Chief of Mission Approval Leter "SIV"

    Hi All,

I have applied for SIV recently, I read some useful information in this blog, is there some one who can tell me how long does it takes to receive a chief of mission approval letter?

this is almost a month that I have applied for chief of mission approval and they says the chief of mission designee is unable to estimate how long the case review will take for each individual case.

    thank you,

    Farhad
