Hubby was found ineligible for the I601 Wavier based on Section 212(a)(3)(A)(ii). They cannot issue a visa who is entering the US for the purpose of committing a crime in the future.

Next Steps: Currently living in Playas de Tijuana, BC. Meanwhile our attorney Laurel Scott has filed an AO last November on our behalf. We will continue to demand that the consulate allow us to file an I601 wavier....

2008 - May - Started expungement process with attorney Leo Lastre.

    2008 - July 8, 10:45 am - 2nd Appointment

1st Issue: CDJ claims a 1993 Poss. of Cannabis/Theft of Lost Property case was still open.

2nd Issue: CDJ questions hubby regarding past gang affiliation. Police Report from 1993 indicated my husband admitted to being a Latin King. Hubby denied the claim and was told to return to consulate July 10, 2008.

2008 - July 10, - CDJ didn't make a decision on gang issue. CDJ requested "final" court disposition regarding the possession of cannabis. His case is now under Administrative process. Hubby was informed by Immigration Officer that any present or past affiliation with gangs resulted in a permanent lifetime ban.

2008 - July 14, - Bridget went to Chicago City Clerk's office to obtain new court disposition.

2008 - July 16, - Requested new court hearing to ask that the Judge remove the "Bond Forf." from case.

2008 - July 23, - Court Date went before Judge. State Attorney abandoned the case. Bonf Forf. removed. New, updated court disposition would be available 5 business days.

2008 - July 30, - New court disposition available. Headed to Chicago City Clerk's office...returned empty handed (bomb threat had to evacuate the building).

2008 - August 1, - Returned to Daley Center and obtained new court disposition. Forwarded originals to Laurel

2008 - August 4, - Laurel faxes and mails court disposition and asked the consulate make a speedy decision on gang issue.

    2008 - August 7, 2:30 pm - Original wavier appointment. Rescheduled.

2008 - August 27, - Requested that Laurel start haggling the consulate for a decision on gang issue.

2008 - September 2, - Laurel sends an inquiry regarding the gang issue.

2008 - September 3, - Laurel calls to inform me of CDJ response to our inquiry. They are conducting background check.

2008 - September 6, - Received letter from CDJ requesting final court disposition. (Already sent 2-3 times). Laurel to follow up with CDJ because we already sent that.

2008 - September 9, - Previous attorney calls and informs me that she received a letter regarding our case. Letter requests final court disposition!

    2008 - September 10-11

2010 - July 30 - Senator's Durbin's office was also a bust. Private bill was not available for my husband because 1. he was out of the country and supposedly its only for those that are still in the country and 2. because only one lucky person gets it per year (according to Durbin's office) therefore someone was already selected.

2010 - August through October 1st - There's really nothing we can do at this point.

2010 - October 5 - Our attorney Laurel Scott has contacted us and wants to do a new Advisory Opinion for us. There were some changes at the AOO and she was much more confident this time around.

    2010 - November - AO was submitted.

Present Day - We are still waiting to hear a response on our AO.
