Thread: Well, we are taking voluntary departure

    Well, we are taking voluntary departure

    I've posted our recent events in the general removal section, however my hubby's hearing was today and was again denied any sort of bond or relief. We will be putting in a motion for voluntary departure tomorrow. Has anyone ever had this request denied? I'm so unbelievably saddened and devastated for our 17 month old son losing his daddy. I've lost complete and utter faith in this country and really just feel hopeless and helpless. It's absolutely absurd that I wish bad things on myself just to prove extreme hardship to allow my hubby to return. No one should ever have to go through this, feel this way....and no child should be ripped away from a parent like my son is. My hubby and son were inseparable...my son was absolutely obsessed with daddy from day 1. This is just unbearable and I don't know what to do or who to turn to.

    I hope the judge grants the VD request. That would be ideal.

    I'm sorry you are going through this. This message board has a lot of similar stories and they're hard to see. I hope you and your spouse can figure out the best way to handle separation. There are many options, but no option is without a sacrifice. I wish it wasn't like this. Best of luck.

    I don't know your husbands immigration history are you guys able to file for COR? My husband got Voluntary Departure through El Paso, Texas in 2008 we had a lawyer. It was really simple he went to a hearing and received it the same day. I went to the hearing and that night he was back in Mexico ( I meet him in Juarez). This immigration process isn't always fair or easy. I understand how you feel. Our family has to wait for 10 years to file visa again (2018). Good luck with what you decide to do!

    The DHS-ICE attorney said they would not fight us on it so hopefully the judge just signs it and gets it over with!

    I hope your request for VD was/will be approved. I understand your frustrations with this whole system and I agree that an innocent child should not have to be separated from a parent in this way. I'm separated from my 3 year old son right now while I'm trying to get my illegal alien wife back from Fiji. She took voluntary departure in August. Good luck and God bless.

    Our lawyer will be putting the VD request in on Monday. We decided to hold off through the weekend so that we could make sure this was the choice that we wanted to make for sure and not go through the appeal process or anything. However, we have decided and will be requesting it on Monday. I sure hope the judge grants the request.

    I don't understand why you are going to separate your husband and your son. You must go with your husband and live abroad. If you love him and your son, of course. Nobody forces you to stay in the US.

    You are right that no one is forcing anyone to stay apart, but it is not always simple to move the entire family to another country. This has to be a personal decision because there are finances, foreign immigration issues, health issues, leaving extended family in the US, losing belongings, employment, and numerous other emotional issues that contribute to the decision to stay or to relocate. No person's situation is the same.

    Sometimes it's just not feesible to move to your spouses country with them. For example, when my husband was in Guatemala I did not stay there with him because I have a very good job here and would not have made any sense for me to move there. We have bills to pay for and i had to send him money as well because be couldn't find work there. So we needed my income from here in the US.

    Yes, you are right. But I strongly believe that my husband will follow me (he is US citizen) and live in my home country with me if I'm deported. He promised me to be with me until death separates us. And I hope he will keep the promise.
