    Apply for an humanitarian parole visa?

    My family have a situation, my moms husband is a lawful resident here in the US, and he has a niece who got impregnated with my brother. They've been with each other for about 2-3 years now, well they want to bring her here to help support her and have the baby here in the States. They can't apply for a B2 visa or a K1 or K3 visa also because problems with her birth certificate.

    They're maybe resorting to a humanitarian parole visa which I never heard of. They want to go that route since can't apply for a normal visa, and she has no help on her side to get the medical treatment she needs, no insurance, no relative support and lack of income. While here, get all the help she can get. Also her fiancé has a hardship to help aide while away. I believe she don't want a permanent stay.

    Just wondering what are the chances of her uncle & fiancé filling for this visa to get approved?

    Her mothers name is not spelled correct. and the Mexican authorities will take 8-9 months to complete it.

    Unless it was a tremendous error (ie, a completely different name), I don't see why this would prevent her from applying for either a K-1 or a B2, either of which is substantially more likely to be approved than humanitarian parole.

    Humanitarian parole is granted only in very extreme cases, and a pregnant woman without insurance is very unlikely to qualify. Has she tried to apply for a BS visa?

    The problem is she is under 18, only 17. She can't get approved for nothing because her BC is no good, need her parent consent.

    I don't think she will qualify for HP because there has to be some sort of extreme emergency or some extreme humanitarian situation in order to possibly qualify. She can always try, but it may not be granted. Is she very sick? Is the baby in danger? A birth certificate issue will most likely not be considered a humanitarian issue if her and the baby are safe and healthy.

    Trying to enter the US so she can have a baby here no matter what visa is probably not an ideal situation even if her family can prove they can pay for her and the baby's medical bills, but it's not to say you can't try.

    Is there any way this birth certificate issue can be expedited in Mexico? Are her parents unavailable to request a correct themselves?

    Why don't her parents request that the BC be corrected?

    In an event, she will need their consent to apply for a passport, if I understand Mexican law.

    A minor spelling error doesn't make the BC "no good." What has she tried to apply for? Any type of visa requires a passport.

    Exactly she tried applying for a Passport but they declined her because her mom name is different than what's on the BC. I mean her mom name is Maria Laura, but on the BC it's Laura Maria. But because of that they can't get it fixed, it doable but very time consuming. Without a passport no way for her to get married, or apply for a visa. So either way it's all very troubling no?

    I do not see the basis for such a visa, but what document would it go in?

    She has people willing to fund her pregnancy, it will be a lot lot cheaper doing that in her home country than the US.

    Does her mother have a passport? If so, what name is printed in the passport?

    I'm trying to think of ways the order of her name is recorded officially as her real name despite the daughter's birth certificate. What does the mother's own birth certificate say?

    Do you think it is possible that if her mother brings in all of this identity information when her daughter is applying, they may accept the birth certificate as is if they see that it was just written in error on the daughter's birth certificate?

    Is there no way to expedite the birth certificate correction process?
