Tudo bem??? I am in Brazil now after being wrongly advised to choose voluntary departure I promptly complied with the order and was told by the judge that I would have no bar period to come back...
Well now that our I-130 is soon to be approved I have been reading online that I might need a waiver since I stayed 7 months in the US after my visa expired ( I had an I-551 conditional residency stamp) while I was waiting for my hearing... even though many would consider this period an out of status period instead of unlawfull presence I am terrified of how the consulate in Rio will view it.
I have read your timeline... Why did you need a waiver? How did it take from the day you filled to the day the waiver was approved? Once the waiver is approved how long did it take for the consulate to give you the visa???

I have a few questions to ask. My case is very common but wiered. i lived in the US from 2003 until 2006. i enetred the US on a c1/d visa and overstayed my visa by living there for more then my stipulated timeof 29 days . but ofcourse i worked on cash. in 2005 i applied for a CSS- LULAC case and attained a work permit and advanced parole. but as soon as my greencard interview was schduled my case was denied and i was back to square one. i left the US in 2006 and since then became a resident of NZ and have been living and working here. Now the twist, my GF from the states whos a US citizen joined me here in NZ and is living with me. She wants to go back to USA cause she has better studying oppurtunities but she has no one to support her as she comes form a very disfuntional family. We want to go back to the US but due o my circumstaces we are reluctant to apply for a K1 visa or matter of fact apply for a greencard staright from here.
We want to get married soon but dont know if i will be allowed to renter.
What should we do? get a B1/B@ go to the US and apply for AOS. Or aplly for a I601 Waiver or Just Aplly for a K1/K3 and hope for the best?

Can nay body please help in giving any suggestions.
