laurel: On Thursday, May 9 I toured the National Records Center in Lee's Summit, MO. That's where your FOIA requests go to. It's where all the files are kept. On Friday, May 10 I attended a tour and meeting at the National Benefits Center, also in Lee's Summit, MO. That's where Provisional Waiver applications are adjudicated. Both of these tours/meetings were set up by the American Immigration Lawyers Association (AILA) and were considered &quot;closed&quot; meetings, which means we need to government to approve the minutes for the meetings before we can really disseminate the information.<br />
<br />
laurel: A few things were pretty innocuous, though, and I don't think it'd be a problem to reveal them, especially since some of the details were revealed in a stakeholder's meeting that I was unfortunately unable to attend as it took place during the tour(!)<br />
<br />
laurel: Here are some of those items: (a) Don't tab your waiver packets. The tabs are removed at the Lockbox and will never been seen by the adjudicator. Same thing if you put everything in a binder or put each document separately into a protective plastic cover. All of those things will be discarded at the Lockbox. (b) NBC had received about 4400 I-601As in the first ten weeks of the program. (c) At the time of the meeting they only had seven adjudicators and one supervisor, but were hiring and training more people. (d) I-130s are being transferred from the Service Centers and sent to NBC where they are again transferred to the local USCIS offices, but you will only get a transfer notice saying it went to the NBC and no transfer notice for the local office.<br />
<br />
laurel: Because of this information, here's what I think is happening with the boilerplate RFEs on the PW cases. The seven adjudicators can't keep up. The volume they were getting means they would only have half an hour per case, which isn't enough. But if they start adjudicating an some people are getting decisions while others who filed at the same time won't get their decisions for weeks - just because of the volume - then those who don't get decisions will wonder why and will start complaining and making inquiries. Easy solution? Adjudicate what you can and RFE the rest. That busy them time until the new adjudicators start. I don't know that that's what's happening. It's just a theory. The truth is that it's not clear why all these boilerplate RFEs are being sent.<br />
<br />
laurel: Last week was a conference in Memphis with the Federal Bar Association (FBA) and AILA. That's the reason I didn't have a chat last week. The Memphis conference went well. I learned a lot about nonimmigrant waivers and about the new paperless I-94 system, but nothing new really about Provisional Waivers.<br />
<br />
laurel: And in other news ... CIR has made it out of committee and is expected to be scheduled for a vote soon. What does that mean? Most bills get &quot;killed&quot; in committee, so for the bill to make it out of committee and get put on the docket to be scheduled for a vote is actually quite significant. It also means that the committee has gotten the bill as close as possible to something that the committee thinks might actually pass. Most of the major points of controversy have been worked out. The bill that is being presented may still undergo some amendments, but all of the major amendments have taken place in committee and what is presented now is likely to be very close to what actually passes, IF it passes. <br />
<br />
laurel: I will have a look at the bill in its present form probably this weekend. But my understanding is that most of the amendments in committee had to do with enforcement along the border and with the employment-based aspects of the bill. I have not heard of any major changes in grounds of inadmissibility or family-based immigration since the bill was originally presented several weeks ago. Very significantly, I have not heard that there are any changes that would allow and EWI to adjust through marriage to a citizen after gaining RPI status, so if such a person wanted to get a green card in less than ten years, he/she would still need a waiver and would still have to consular process. But I will check on all that this weekend.<br />

My husband's medical records finally made it to the Embassy yesterday. Since that was the only requirement we were waiting on and I knew Zelaya had everything already, we called in the beginning of May to make his 2nd visa appointment and we were given JULY 12TH!! two plus months away... Well I gotta tell you my hubby got a call from the Embassy today to give him clearance to make the 2nd visa appointment since they have all requirements submitted... really!!!!!! Had we waited, his appointment would have been in August... But any way... could anyone tell me why this rep couldn't see in my husband's record that he had an appointment already (do they use different systems?). And what about the fact that some of us get calls... some get emails, text and others have to call in to them... and I am not even going to start about the semi-correct answers we all get from these people... timeframes...reasons... etc. In conclusion (of this BEASTFEST) we are just peeling onions with this immigration process... layer after layer... they make us cry and they stink!!!!!!!!:pullinghair:oh yeah...GOD BLESS THE ONIONS</font></span></div>

ILA's summary of today's markup. Today’s markup was short and sweet, done before 1:00pm. The Committee considered 15 amendments and passed 11 (4 on Title IV and 11 on E-Verify). Over half of the amendments on E-Verify were offered by Senator Grassley, everything from delaying the preemption of State and local laws until E-Verify is nationally mandated, to requiring an 18 month implementation deadline for businesses to implement E-Verify nationally to protecting children from identity theft.<br />
<br />
However, one of the most contentious Grassley amendments came on the second to last vote of the day. Amendment Grassley 34, which would make document fraud (knowingly transferring, possessing, or using, without lawful authority, a means of identification that is not their own) a crime punishable by up to 20 years imprisonment if such offense is committed to facilitate or assist in harboring or hiring unauthorized workers, turned out to be the only party line vote of the day, failing 8-10.<br />
<br />
Although Sen. Leahy (D-VT), chairman of the committee, had made a lot of threats earlier this week of extending markup days to tomorrow and Saturday, in reality the committee finished their work on Title IV and the E-Verify section of Title III in record time. This mean that the committee won’t be reconvening until Monday, May 20th, at 10:00am to continue with the other sections of Title III (and then moving on to Title II, legalization and the legal immigration system, before the end of next week). The only exception will be a return to Title IV to vote on a potential deal between Sen. Hatch (R-UT) and members of the “Gang of Eight” on several of his amendments to the H-1B program.<br />

Tomorrow is the second day of the Senate Judiciary Committee mark-up of S. 744, the immigration reform bill. Next up on the agenda is Title IV, nonimmigrant visas, including H and L visas, and the guest worker program (W visas). Please take 5 minutes in the next day to call your Senators.<br />

Here is a sample script to use when you call:<br />

SCRIPT: My name is [YOUR NAME] and I live in [CITY, STATE] and I’m calling in regards to the mark-up of S. 744. I am calling to ask Senator [SENATOR’S NAME] to support Hatch amendments 11 through 17 and to oppose Grassley amendments 54 through 77 in the Title IV mark-up on Tuesday. I also urge the Senator to support Blumenthal 14, Coons 9 and Hirono 6 in Titles II and III of the bill.<br />

Many elements of this bill reflect an understanding that foreign nationals can and do contribute to America’s economic growth. All of the bill should fully embrace this concept. For example, the increase in the H-1B cap to 110,000 is a step in the right direction, but may not be sufficient in the earlier years to meet the country’s needs.<br />
<br />
<br />
· Highly skilled immigrants complement their native-born peers; they do not substitute for them. This is true throughout all high-skilled occupations, but is particularly true in STEM fields. STEM occupations have very low unemployment compared to the overall national unemployment rate (which stood at 7.6 percent as of March 2013). Arguments that immigrants are depressing wages or freezing out native-born workers belie the available evidence.<br />

<b>INA 212(a)(6)(B) - 5-year ban with no waiver available</b><br />
The most common instance of this is a non-Mexican who EWI through the U.S.-Mexico border, was stopped by border patrol, detained briefly, given a court date for some time later and then released into the U.S. Typically, people skip these court dates and remain in the U.S.<br />
<br />
Just to clarify, Mexicans in this situation (caught by BP in the wilderness) are generally taken back across the border and not given any sort of formal removal (or a court date), so this bar does not, by any means, apply to everyone caught crossing the border.<br />
<br />
However, if at some time during a person's stay in the U.S., they were issued an immigration court date but DID NOT ATTEND, this bar would apply once they leave the U.S. As of Feb. 2011, several members from El Salvador, Guatemala, and Honduras and several members filing in Lima have been stuck with this bar AFTER filing their I-601, so please be careful if this could apply.<br />
<br />
Many times a person is inadmissible under 212(a)(6)(B) along with a ban for illegal presence (212(a)(9)(B)(i), 212(a)(9)(B)(ii)) which are immediately waivable but the 212(a)(6)(B) finding will prevent the intending immigrant to complete the consular process.  Ideally this finding should brought up at the initial visa interview but many members have not found out until after paying and waiting out the I-601 processing.  If you suspect this ban may apply to you a <a href="http://immigrate2us.net/forum/showpost.php?p=731134&amp;postcount=4" target="_blank">FOIA request</a> should be sought before leaving the country voluntarily. <br />

I have a friend, Sierra Leone national, who has been granted a B1/B2 visa. She came to the USA and had her two children within three years. Her Health care provider overseas paid for the cost and she paid balance in cash. In 2010, and one month before the expiration of her visa, she received a phone call from the American Embassy advising her that her visa was revoked. She visited the Embassy, and was advised that the Embassy received instructions from Washington DC to revoke her visa. No reason or document was given. Her visa was stamped &quot;Cancelled&quot;. <br />
<br />
Now she wants to visit Disney Land in the US with her two US citizen children. She went to the Embassy to apply for a visa and was advised that, even though she can, she would not be granted a visa. She was also told that in the case of refusal, the Embassy will tell her what the reason for refusal is. She did not apply. <br />
<br />
Why would her visa be revoked/cancelled? Should she reapply? Or should she wait for a specific period?<br />
<br />
Please advise. <br />

Now after worrying all the time will it get approved or not, I have another problem:blush:. I heard some horrifying story's about immigration officers ,that open my big brown envelope as soon as i touch down in the states, that they can make the final decision if they let me &quot;in&quot; or not, and that they ask a lot of questions.Does anyone has any experience about going through POE in seattle on a I-601 Waiver? <br />
