I have a friend that is an EWI but is married to an LPR. She is in a horable marriage where her husband was just released from jail for abusing her. He is threatening her to call Immigration if she tries to leave him and he will take the children away from her.
Does anyone know a similar situation and their result of filing an I-360 self petition based on violence against woman act?
She doesn't have the money to hire a lawyer and just wants to do what she can to get away from the situation and not get deported and loose her children.

has she considered legal aid. Many states and communities have programs for women in situations like this. Like the domestic violence division with the county. I doubt that if he calls INS they are just going to show up at her door and magically take her away. I've been in this situation too and the domestic violence unit in the city helped me out and provided free counsel on my behalf. She just needs to stay safe and when he comes crawling back to her crying she needs to stand her ground if she's going to pursue this. As for the petition I'm sure you could find out through Laurel if she should or can file. www.visacentral.net 11am central time it's a free attorney attended chat.
Good luck to your friend.

I don't know anyone who has filed an I-360, but I just wanted to say that a social service agency, like Catholic Charities, may be able to provide some assistance. I don't know where she is living, but in Arkansas they offer immigration services in Springdale and Little Rock.
Hopefully, someone else will come along with some more specific information about VAWA. I hope your friend finds safety with her children. Best of luck:)

Perhaps the easiest and quickest way for anyone, women or man to get a GC now. The required evidence bar is extremely low and easy to provide.

Another option for situations where the alleged abuser is not related or is a neighbor. Or if its not based on abuse.
