I am waiting on the waiver aproval. It will be 5 months in March or 6 months in April. On April 10 it will be our 2nd anniversary will he still receive a conditional visa, if he is aproved in April?

If he gets his visa after April 10 u shouldn't need to remove conditions.

Even though you will have your 2 year anniversary in April, I am still hoping and praying that your hubby gets approved in 5 months! You can deal with removing the conditions later. For right now, you just want him home.

We had our interview on Feb 5th. Unfortunately, we´ve had to delay submitting our waivers because the officer who interviewed us made a mistake. He appeared to be very new and seemed confused with the details of my husband´s circumstances. He told us that only the I601 is required, when in reality we need two waivers. He put information into my husband´s file that says he stated that he was given voluntary departure, which is not true. He left the US on his own, but he was deported in absentia.

Its all very frustrating! But, we´re trying to work everything out with the embassy now so that things aren´t delayed more in the future.

Hello, I hope everybody is doing well. I just heard from a lady in Guatemala that received her aproval. She was aproved in February and she is back in the USA. She did not sign in before because she was so busy but she mention she heard of 4 more aproved cases all of them in 6 months. My waiver was entered in the system on October 24, 2007 so I should receive our aproval on April. Please pray for me. When I receive more information from this lady I will let you guys know.

Sorocco: Just when I was going to write you a PM to see how you are doing, I read your post. I have been thinking about you because I know you are getting close. Any information you could obtain from us from your contact would be greatly appreciated as there is not a good source or enough good sources of waiver approvals in Guatemala.

We are all praying for you that this nightmare is over soon and that this time next year, there will be a little one in the making at least. What beautiful children you will make together.

Djones: my husband and I have been talking about a baby. I been thinking about making an appointmen with my doctor to start taking vitamins or do anything necessary to prepare for a good pregnancy. Thank you for your wounderful comments you have been a great support to me. I wish the same happines for your daughter and son in law.

Sorocco: That is funny that you said that because that is exactly what my daughter's doctor told her to do. She started taking vitamins months before she knew she wanted to get pregnant and they even had her take pre-natal vitamins and iron before she got pregnant. I had never heard of that before but I guess more and more doctors are now recommending it.

Thank you Jenny I feel very positive. My friend who just got aproved mentioned that she received a call on a Thursday and she was given an appointment for the next monday at 11am. All she was requested to take was her passport and the 2 police records (Policiaco and Penal)

She mentioned that she used to call to ask about the waiver to the following numbers: 23264000 ext 4226 and ext 4498 with Joseph whom she said is the person in charge of aproving the waivers.

We turned in our waivers on March 6th. The trip went really well and the people at the embassy were very helpful. They had realized there mistake and told us that we did need both waivers.

We found a great hotel/hostel called Xamanek within walking distance from the embassy and it was only 214 quetzales for both of us with breakfast included, it was so convenient to be close. My husband left at 4am to be the first in line and I followed around 7:30. If you don't submit the waivers the day of the interview you are given a yellow sheet with instructions to be there at 11am, but they only give out 36 numbers so its important to be there early. The most recent two times we've been to the embassy I've noticed that they are really busy.

They told me there's a 6 month processing time for the waivers. I asked him where they are adjudicated and he told me that the waivers are packaged and sent to DHS in Guatemala and sometimes they are then sent to DHS in Mexico. I didn't realize that Mexico had anything to do with Guatemala waivers, but that's what I was told.

So we are very relieved to have this over with. Now there's nothing to do but wait for their decision.

Hello everybody,

My hubby is home and last week on Friday my hubby received his Green Card. It took about a month an 1/2.

Immigrant Visas
The Immigrant Visa Process
1. THE FIRST STEP - THE DEPARTMENT OF HOMELAND SECURITY
The process of applying for all categories of immigrant visas begins with the Department of Homeland Security (DHS). In most cases, this consists of filing a petition with the DHS office having jurisdiction over the petitioner's place of residence in the United States. The petitioner should contact the appropriate DHS office using the Government Pages of the local telephone directory. In a limited number of cases, if the petitioner can demonstrate current residence in Guatemala for at least six months, the petition may be filed with the DHS office located in the U.S. Embassy in Guatemala. The DHS office in Guatemala holds information hours on Monday at 2 pm and Tuesday through Thursday at 1 pm at Window 7 of the Consular Section. Many DHS forms are also available at:

2. THE SECOND STEP – THE NATIONAL VISA CENTER
Once DHS has approved a petition, the petition will be forwarded to the National Visa Center (NVC). All petitions are administratively processed at the NVC. The NVC will forward all Immediate Relative petitions to the embassy specified on the petition. The NVC will store all preference petitions until the priority dates are close to being current. When a petition's priority date is current, the NVC will mail the applicant a packet of information instructing the applicant to assemble necessary documents, complete a biographical information form, and send the form to the specified embassy. 3. THE THIRD STEP – THE EMBASSY CONSULAR SECTION
The Consular Section in Guatemala receives the approved petition from the NVC, and awaits the applicant's completed DS-230 Part I forms along with the completed DS-2001. Once the Embassy receives these completed forms, the applicant is considered "document qualified." If the petition is for an Immediate Relative or for a preference category with a current priority date, the Consular Section will schedule the applicant for an appointment approximately two months in the future and send the applicant notice of the appointment date, the medical exam requirements, and a few more forms to complete and bring to the visa appointment. Petitions with priority dates that are not yet current are stored until the priority dates become current, at which time the embassy schedules the appointment and sends notice to the applicant. Interview Requirements
The visa interview will be scheduled only after the petition is approved, the priority date is current, and the applicant has returned the completed DS-230 Part I forms along with the completed DS-2001. Attorneys may not participate in applicants’ interviews.

Applicants appearing for an interview must present their appointment letters by 7:15 am the day of their interview or they will not be interviewed that day. Interviews are conducted Monday through Thursday only. When a visa is issued, it is usually printed later that same day.

Passport The passport must be valid for at least six months after the date of the visa interview. Every applicant must have a passport with correct biographical information. If there is any error in the biographical information, the applicant must have it corrected by the proper authorities prior to visa issuance. If the applicant has previously traveled to the United States, the applicant should present any previous passport(s) in addition to the current passport.


$380 Total Fees (or the equivalent in Guatemalan Quetzales) These fees must be paid to the Consular Section cashier prior to the interview (unless paid at the National Visa Center).


Photographs The applicant must attach two (2) recent, color or black and white photos (2" in height by 2" in width, face 50% of photo, white background, ears and forehead uncovered, without earrings or hat). Click here for more detailed information about photo requirements.


Form DS-230 - Application for Immigrant Visa and Alien Registration A completed Form DS-230 is required for each applicant regardless of age. All of the questions must be answered. Please do not sign the last page of the form until the Consular Officer instructs you to do so at the visa appointment.


Birth Certificate (original) A valid birth certificate must be submitted for each applicant.


Marriage Certificate (original) Each married applicant must submit a valid marriage certificate. In addition, applicants who have been married previously must submit original or certified evidence of the termination of the prior marriage (certificate of divorce or annulment or death certificate of the previous spouse).


Medical Examination Every applicant regardless of age must have a medical exam performed by one of the embassy's panel physicians. Each applicant is provided with more information regarding the medical exam when the applicant is notified of their visa interview appointment. The panel physicians cannot perform the medical exam until the applicant has a scheduled appointment. The applicant must present the visa appointment letter and a valid passport at the time of the medical examination. Approximately two days after the exam, the panel physician will provide the applicant with a written, sealed report for the applicant to bring to the visa appointment. Medical examinations performed by physicians other than the embassy's panel physicians cannot be accepted.


Evidence of Financial Support. Each applicant for Immediate Relative or Family-Sponsored Preference visas must submit an Affidavit of Support, Form I-864 (see more information below) completed and signed by the visa petitioner and notarized by a Notary Public in the U.S. or by a Consular Office at the Embassy. The petitioner must also submit copies of their Federal Income Tax Returns (Form 1040 including all attachments and Form W-2) for the last three years and proof of employment such as a notarized letter from their employer. If the petitioner's income does not exceed 125% of the current year's Poverty Guidelines for the petitioner's household size including the sponsored applicant(s), the applicant(s) should also submit an Affidavit of Support, employment proof, and copies of the last three years federal income taxes from a joint sponsor. The joint sponsor must have income exceeding 125% of the Poverty Guidelines for the joint sponsor's household size, including the sponsored applicants. The joint sponsor must be a U.S. citizen or Legal Permanent Resident currently domiciled in the U.S., and should be a relative of the petitioner or applicant, but non-relatives may be accepted if there is a lengthy and strong relationship. The income of the petitioner and the joint sponsor may not be aggregated in order to meet/exceed the income requirements. The joint sponsor, if there is one, must meet the income requirements independently. The petitioner or joint sponsor may include in the income listed on their respective Affidavits of Support the income of other individuals who have shared the petitioner's or joint sponsor's residence for at least six months and are related to the petitioner or joint sponsor by birth, marriage, or adoption. Each household member contributing income (co-sponsor) to the total income listed on another person's Affidavit of Support must complete Form I-864A, the Contract Between Sponsor and Household Member. Medical Examinations & Laboratory Tests
The cost of the medical exam and requisite laboratory tests is $100 for adults and $85 for children under 15 years. The applicant will also bear the cost of any required vaccinations. These fees must be paid to the embassy panel physician directly.

This is going to be a great month for me and my husband, we are hoping to hear about the aproval anytime during this month. I called today to ask but the answer was "we have not hear back from them" so I don't give up I will call once a week and will keep you posted.

Hello!

Today finally, the embassy called my husband to let him know that he was aproved :yay2: Since we already knew the next step my husband had the police records ready they ask him to take those 2, passport and a yellow piece of paper that they gave him on one of the appointments (Since I have not seen it, I cannot recall) but I asked my husband to make a copy so that I know for future reference on the cases that are still pending.

Since my husband will go on Monday to pick up his visa I need to buy his plane ticket to leave on Monday evening or Tuesday around noon. So far looks like Delta has tickets for $337.00 on way Guatemala -LAX Los Angeles, he can also travel Guatemala - San Diego which would be more convenient. On monday when he goes to get his visa he will ask if he can travel to Mexico first, that would be great because in that case he could travel from Tapachula to Tijuana and it would cost only $150.00. Please let me know what airlines have you used on the past.

in nc usairways has a direct flight for $560 round trip so I'd be happy with $300! I usually search on kayak.com for the cheapest and then get it from the cheapest place. I am sooooo happy for you. Hubby is excited cause he says he'll be in gua by Christmas. :( well I guess I'll see what the cards hold later.

Sorry to bother, but since I did not received many answers I was kind of sad, but I saw people from Guatemala posting and that gave us hope, here is a copy of what I posted earlier:


I was deported six years ago, because I received an overpayment from the Social Security Administration for my daughter whom is disabled. I was charged with Theft and soon after my deportation the charges were disposed.

Its has been six years and my daugther is facing extreme and unusual hardship. She has not been able to attend to school since we arrived, there are no programs for children with disabilities (Down syndrome), there are no medical facilities nor appropriate medical care for her, no insurance will ever accept her because pre-existing conditions. She has a heart condition, tyroids problems and some other medical complications but we are concern mainly of her heart. She will be 16 years old next month.

My other son attended an american like school here for the last 4 years but because of changes on the school regulations he was not accepted back, so now he can not attend school because the school is not acreddited in the country (only in USA) so he can not attend school either.

My question is, how can I begin to try to return legally to the US? given the charges of theft, misrepresentation and working without permit.

Any advise is greatly appreciate it.

Wow AndGor..that is a tricky situation. The thing I do know is that they have to be 21 to petition for you but I don't know how that works if they have disablities....you're better off to ask Laurel Scott on Wednesday @ 11 am cst on www.Visacentral.net I do hope that everything turns out okay.

Well I am still waiting for my husband :waiting:
On Monday morning he was traveling from Nebaj, Quiche he was supposed to arrive at 4 a.m. to Guatemala City, the bus broke down, another bus pick them up and he was at the embassy at 7:30am he was told to go pick up visa from 8 to 11am. He got on the line but he did not get a number, they told him to return the next day :shy: Next day he is at the embassy at 5am in the morning he gets a ticket # 3 he is really happy :yay2: at 11:30 he gets called to the window and they tell him to return at 2:30pm, he returns and finally they call him almost at 4pm they tell him everything looks good he has been aproved for the waiver and to return tomorrow at 3:30pm to pick up the visa. He asked if he should come early to get a number she gave him a piece of paper and instructed him to return and he will be able to go in with out a problem. I am so glad that I changed the flight ticket for him to leave on thursday at 8pm I figured he might have problems and he would have 3 more days to get it done. Well this gives me time to decorate. I m:bleh:ade a welcome home sign and I plan to have helium ballons and on the strings I will hang notes and pictures.

My Wife's visa papers were approved March 4th. She's an ewi, voluntarily departed. I hope to put in the petition ASAP

She is recently pregnant. When she had our first son she lost 6 pints of blood due to blood clotting issues. She had bloody noses that lasted hours at the end of her pregnancy. Finally we found a doctor in the US to enduse her, and the bleeding stopped.

My point . . .

I probably have no chance, but I am going to try to see if a note from her US doctor will expedite things.

Guatemala has crappy doctors that will tell you anything you want to hear as long as they get payed. I am scared for my wife and future child.

Welcome Guatemalan lover, I hope they would let her come to the US to give birth. Anything could help. I understand about the doctors, my MIL has a hysterectomy and wound up going to the hospital 3 times after they were finished because she kept bleeding and my hubby's father went in the hospital to get his appendix removed and wound up dead. granted that was 23 yrs ago but my MIL had surgery this year.

My husband is from Zacapa, Guatemala. Right now we are waiting for a responds from the NVC. It's been a month and a half!! Hopefully some sort of good news is on it's way!!

Your right djones9714, guatemalan lover is not approved yet. He PM me and stated that his visa papers got approved, but I guess he meant to say that his case got completed and he's just waiting for the interview.

I just got excited, but I wish him the best and pretty soon he will get approved!!!!!

So I am here at the cafe internet with my wife and son. I showed her the forum and she is very happy to know that we are not the only people who are ready to petition any denial on my wife's visa interview. She seems content and every time that I tell her that her visa will probably be denied she now knows that I know what I am talking about with the I-160 petition hardship deal.

I keep telling her we will ber back in the US in 9 -12 months. My case papers were finished and processed march 4th 2008. It is the second week of the month wich means that the new interview list was finished for the month of June. I tried calling the NVC to se if there were any updates, but there were done.

Well I am going back to the US to work. Going to make some money for the pregnancy.

Just want to thank you all for posting your stories. My wife says hi, and my son is sleeping.

Guatemalalover: I was figuring that the second week of the month was next week -- not this week. That is what the NVC told me -- to call back after the 15th.

Do you have any proof that they are finished scheduling for June?

Also, do they update the NVC case line information when they schedule your interview? Does the message state this information?

Andgor I think this was already answered in this same thread, I believe you said that you did not have a USC filling an application for you and since your kids are under 21 they are not able to do anything for you yet. I am not sure if something like a humanitarian visa would or could be granted in a situation like this but your best option is to consult with an immigration lawyer. I am married to a Guatemala citizen and I know I will need to file a I-601 waiver to prove hardship because he is illegal in the US. My question is, will Guatemala implement the pilot program that is currently used in Mexico, to keep families together? The reason why I ask is that I am an Army veteran and was diagnosed with PTSD among other things, I am also 60% disabled through the military, and my husband is the only one who doesn’t make me go paranoid. I don’t know how he does it, no one else ever could, (that is why I married him). I have panic attacks just thinking of it. We very much sympathize with your situation and commend your service to our country. Unfortunately at this time we are not aware of any plans to make changes to the current I-601 waiver application process, which normally takes around 6 months.

Mexico has that program simply because of the huge number of waivers that are filed in that country.

I doubt that Guatemala will have the same implementation of that program anytime soon. There is just not enough mass demand.

However, PTSD is excellent proof for your I 601 waiver. Hope everything goes well JennyM.

We on the other hand are waiting on 2 things: interview in Guatemala and birth of baby. We are taking votes on which comes first.

My wife’s interview was scheduled officially in Early June! Yay!

I am back in the USA working and making some money for plane tickets, baby deliveries, and to drive my car down to Guatemala in Late September.

So I know my wife will get denied at her interview; however, at least I can send my hardship papers and see what happens.

Here are some of my hardships. I am a student finishing up my Minor, and need to finish my Major and get my licensure to Teach. I have been documented sick 3 times in a Guatemalan hospital. Once for Salmonella, the other for Epileptic shock/stroke (according to the doctor, yet I think it was a very bad migraine that lasted 2 days. But I do have a clinical US record for severe migraines, and if doctors in Guatemala are treating me for Strokes and epileptic shock, I am sure that isn't good.) Oh and just recently I got Hepatitis A.

I have lost 70 pounds since I have lived in Guatemala. I owe the US government like $25,000 in student loans. I have insurance up here, and my wife, son, or future child cannot use it in Guatemala.

I am for sure going to talk about my depression and how I would of been graduated by now, and my life and paying back student loans in Guatemala isn't possible, and separation of my family is and will be an extreme hardship.

Also on the other letters posted on this website they have great ideas too. All I know is a hardship letter wouldn’t be too hard to write. I have lived in Guatemala for over a Year, and flying back and forth to the US is going to kill me one day.

Blah Blah . . .

I will let you all know what happens and I hope my story will help out.

I am glad to have an opportunity to post with you all. Will let you all know what happens when the interview comes up, and when I get my interview pack, and send my hard ship letters.

The bad part....it really has taken a toll in my life...but...everything happens for a reason, and if I didn't go through that, I wouldn't have a better case today.

OMG! Congrats :yay2: I'm working on 6 months for my stinking approval on my I 130!!!! :puke: (to immigration) :)


As for the costs, the waiver is $545; I dont' think you needed the I212 right? or did you? Anyway, that is $545.

Of course you have tons of ideas for your HSL! I bought colored tabs (a-z) so I can appendix all my drs letters and other infomation listed in my letter. I know mexico is different when it comes to tabs and binder clips and staples. I'm not putting staples in anything. (I personally hate them) I might get a 3 prong folder or something to put all of it in though.

Make sure your letter really focuses on the emotional and pychological problems you are experiencing. Those always pull the most weight. Financial hardships pull much less weight with I 601 hardship explanation letters.

I recomend seeing a psychologist. They can evaluate you and write a letter in support of your case. My appointement was scheduled by my attorney and cost me 200 dollars.

I went down to the local health department and they set me up with a psychologist. My goal is to get the documentation that I am clinically depressed due to the separation caused by the immigration laws and any other stress factors associated with the situation. I also want to get some migraine notes from other doctors.

Right on Guys. I will make sure I keep you all informed if any thing happens.

It feels like never! Hubby wanted to be down for christmas but its looking like that won't happen if they won't approve us. I am going with him for maybe 2 wks or so....then I'll travel every couple of months like you did....I'm really not looking forward to it, and I can FINALLY meet my MIL and SILs and BILs. That part I can't wait for!

Just realized maybe I'm being to personal, you don't have to answer if you don't like.

I'm not sure if you have ever been there or not, but I like to go. Always have a great time.

Hi just got back today. Was a fun trip though I am sick again like always when I go there (this time massive head cold with congestion so bad I can barley hear)

We are expecting to hear something around the end of August. That will be 6 months so lets hope it's approved.

No, he's here. We were talking to my BIL the other day and we're making plans like the buses to use and where we will visit...etc etc...and my BIL goes "What about me?" I told him that he wasn't going anywhere until there is a reform.....he is EWI back in 98....he didn't know that he could file asylum in 2000......I wish he did....
