View Full Version : can a Mexican National get a tourist visa if she is married to a US military person

I have a friend in Tijuana Mexico, that is married to a U.S. sailor, who for what ever reason does not or has not filed for her spousal status. He come and goes as he please's usually sees her once or twice a year for a week or two at a time, they have a daughter who does have her American passport. Does she have a chance to get a tourist visa? or will she be denied because of her marriage to a US citizen.

Applicants for tourist visas have to prove their non-immigrant intent. So it makes sense that people who are married to US Citizens would have a slim chance of getting one. That said, the situation you are describing is pretty unusual so it's worth a shot. All she would lose if she is denied is the cost of applying.

So does she say she is not married? And how does one prove non-immigrant intent? She basically just wants to be able to bring her daughter to San Diego every now and then.

Well no since lying on any immigration paperwork carries fines and penalties for perjury including imprisonment! Things that prove non-immigrant are things that show she has no intention of immigrating while in the US - that means any and all ties to her country i.e. a home, a job, a bank account, children who live there, anything and everything that will show, beyond any doubt, that she has a life in country and once which she intends on returning to. Take a look at the information regarding tourist visas on the the US embassy website in Mexico. As I recall, it's pretty clear what they require.
