View Full Version : My 212(d)(3) expience any comments & sugestions?

Hi


I wanna post my exprince in 212(d)(3) wiver


1. I was removed to india in aug 2004 by that time i had my i-485 pending based on approved i-140 priority date april 2001

2. I violated my student visa status in 1998 and applied for asylum and it was pending till i was ordered removed in 2004

3. Hired a lawyer to take care of my waiver she was very absurd and reluctant didt do anything only thing she has been advisong me is to get married to USC I refused.

4. did reserch and found that i can apply for NIV with 212(d)(3) eplained to my lawyer she was clueless . so i came to canada on work visa and contacted to lawyer and requested her to file my 212 and L1 visa ( she took huge amounts of payment but did nothing)

5. she wasted time giving ecuses till 2007 finally i fired her and filed L1 from another company and got it approved in 7 days

6. on march 30 2007 i went for interview i toll FBI report Canada RCMP report , indian police report and nevada police report ( where i was arreted and charged vth violation of status)

7. VO looked into my application and the l1 approval and askd me to explain what happened i did

8. she asked me do u have ny more info on when u where arrested i gave all police reports she looked and said .. I need to get your records and check if there is any thing else we need to worry about. they took my 10 finger prints and i paid 85 dollors.

9. on may 3rd 2007 i got a call to come back to consulate i was busy so i went on june 7th they said CBP said i had medical issues so i need to see a panel doctor i went to panel doctor he gave me some forms and asked me to take it to my GP.

10. i went to my GP he gave me clan bill of health i took all filled forms and sent them to panel doctor week later he called me for appoit ment and i went few checups he said i am clear.

11. after one week he called and gave me sealed envelope to give to consulate

12. on june 28th i went to consulate again gave my medicals she looked and said ..you dont have any medical issues but scince you have been removed you ae ineligible for visa but i am recomending you for waiver it takes bout 4 to 6 weeks.

13. on july 27 i got a mail from consulate sayng we have fawarded your application to DOS washington for review advisiory opinion we have no control and length and scope of this review.

14. aug 1 i called dos washington dc they said they have my appliction and it has been with them for about a month nd its still pending asked how long it takes she said we will let you know as soon as its done.


15.so now i am still waiting i remember guy from germney he applied on july 17 2006 he got response on aug 11 2006 about his records ad on oct 3rd 2006 it was approved now how long dos takes it before they sedn to DHS for fial approval anybody?

i have no clue on these L visas, but i hope you stick around to educate those who may need that info!

Waiver for L visa is like any other non immigrant visa .. advantage of L and H visa is that you can have dual intent you dont need to show strong ties to your home country ( basically you will be eligible even if u has USC wife of previous or present immigrtion petetion etc )

its normal 212(d)(3)

yes i filed in Toronto and they farwarded to DOS for advisory opinion on june 28th still waiting

June 28th of this yr? Wow do they really process cases faster in Canada..., Just call them evey week..... maybe they'll get tired of you calling and just approve you :)

Then where in the world is your approval?!!!!
Why are they taking so long it's almost like 2 months...

thats why i am worried and waiting

once consulate is satisfied with your Visa eligibility

1. they will send a recomendation to DHS to approve the waiver for temporay entry

or

2. if the visa is for more then 1 yr then they will send it to DOS for advisiory opinion DOS then sends that to DHS


they told me 4 to 6 weeks and it will be 6 weeks by tomorrow still waiting its at DOS now

there is another member who applied for his F1 from malsiya and used 212(d)(3) it took 4.5 months for him as he needed security clearences. my securitys clearences are already done.


another member from germany it took 2.5 months and 1 month in that was for for his clearences so its 1.5 month it took it took for him to recive the visa in mail.

spoke to Laurel about this she did say she is not shure about this but normaly when Attoney requests DOS advisiory opinion it takes about 6 months. but when consulate requests it must be defferent.


now only case an attorney requests a dos opiion is in Asylum its entiely deff and they give advisiory opinion if the your detained it takes 3o days of your not detained 6 months.


anothe case where DOS advisioy opinion can be requested is in J1 visa holder requets for waiver DOS says its takinf 4 -8 weeks to process this requests at this time.


now its still confusing how long dos takes in my case ...
