View Full Version : Anyone who had appeal at AAO

Our appeal has been at the AAO for our I-601 denied at Athens since April, 2006. I received a letter today from my Congressman saying our appeal was "'dismissed' on July 13, 2007 and the file was sent back to the originating office."

We, neither I nor my attorney, has received any notice yet other than this letter from the Congressman.

My attorney feels this means the appeal was denied, but I seem to remember others who had a dismissal and it meant something else. What was your experience? If it was denied, was your file sent back to the originating office the same day? How could you appeal if they sent the file back?

Since we haven't received any details, we haven't decided what to do yet, but I would appreciate sharing your experiences for those that got an answer from the AAO.

wasn't it billchris who went thru the appeal process and got approved?

you know, blue, i don't know what it is with communication between the immigration offices and lawyers, but we also had to find out thru our senator that our file had been transferred to ICE.

i wish i could help you with your question, but thinking back doesn't that mean the AAO couldn't reach a decision and so sent it back for the original people to try and figure it out again?

I am sorry to hear about your dismissal. Your lawyer is right, dismissal is a denial, at least that was my case. You can call the AAO at this number and ask for your case. (202) 272 1212 , they will ask you for your A# , You can call during the morning.
Answering your questions:

was your file sent back to the originating office the same day?

In my case, the file was sent back first to Mexico, then to the originating office and it took about a month not the same date.

How could you appeal if they sent the file back?

If you are planning to appeal, the file will go back and forth from the originating office to the AAO. If the AAO denied your case, they send it back to the originating office and if you want to appel again the originating office will send it back to the AAO. You have to wait for the dismissal letter in order to continued with what you have in mind.

Your congressman can help you. I do not about your case, but if you really have a strong case and believe that your denial was wrong, you can keep pursuing. You also have the option of a new waiver.
