me and my fiance have been together for 3 years we have a beautiful son and plan on more ... when i met him he had only been in the country for a feww monhts , but i didnt care about that i taught him english and he helped me fix my broken spanish lol now that we want to get married we dont even know how to start ... he came here illigally from mexico, has no criminal record ... what should my first step be ? we are both young but so in love and just praying we can make this happen ... please help us out we are so lost.

You can make this happen! There is hope. If engaged, you can start with the I-129(f) (which you can download at uscis.gov). If married, you would start with the I-130 instead. It will take several months to be approved. Then, you will go through processing at the National Visa Center, which takes a few months as well. Then, you will be on your way to an interview in Ciudad Juarez, Mexico (He can't adjust status here because he entered without inspection). Once he leaves the U.S. for his appointment, he's subject to a 10-year bar. But, you can file an I-601 waiver, if he is eligible. When you file the waiver, you have to prove that you would suffer extreme and unusual hardship if he weren't allowed to return for a decade. This requires writing a hardship letter, with documentation. If the waiver/letter is clearly approvable, then he can potentially return the very same day. The whole process may take approximately 10-18 months, depending on which petition you file. It will probably cost at least 2,000 in immigration fees, but likely more with plane tickets, hotel reservations, etc. Good luck! It is possible to do all of this on your own, by the way. It's always a good idea to do an initial consultation with an attorney, to make sure you understand the case though. Some are more complicated than others, especially those with criminal history or multiple entries. Anyways, if I forgot anything important, someone will chime in:)

it will help prove validity in your relationship that you have a son, but it will not help to expedite the process.
