View Full Version : How do you get information on an Expedited Removal?

My husband was detained by ICE at the local jail and then he signed the expedited removal paperwork. He was then flown back to his country. How do I get the details on his case so I can provide them with my I-212 waiver?

He should have about seven pages of information that were given to him by the removing officers. The have to give him a copy of whatever he signed.

If this is lost, you do not HAVE to have a copy of it, the instructions say to send "whatever you have" in relation to the removal. . .they can probably get the file sent to them at the same speed you could.

If you really want a copy for your own records, you can do a FOIA directly to the point of entry that handled the expedited removal or to Customs and Border Patrol themselves. You will need to provide the dates that all of it took place in order to narrow down their search.d

If it all happened at a local jail, the jail might have copies too.

The FOIA request would also let you know if there were any additional charges with the expedited removal.

He was in Ohio, and the local police picked him up for not having a DL and then put him in jail, they dropped the charges but handed him over to ICE and they took him to Boone County, KY. That is where he signed the papers. They kept him there for a week and then took him to Cleveland and flew him to Mexico. He says he does not have any paperwork for this. So I am not sure who to contact to find out the details.

No problem. . .with all the information you have there, plus the dates they should really be able to give you the paperwork.

hi,
Would like to jump in ! I was agiven the deportation paper which is lost. Can I get that using FOIA.
Also do I need the original or copies would do?

For submitting the waiver you only need copies and yes, if you submit an FOIA properly they should be able to get you copies of the deportation information as long as you still know the dates and location.
