View Full Version : Tough Situation Waiting waiting since12/2005

:cry:Hi I have not really posted much but I read alto of the forums and this site has help answerer alto of my questions but at this time I am struggling threw a tough situation. My husband had his first appointment in Juarez in 12/2005 but we did not file a strong hardship letter we had gone to a notary in the first place and he never told me I had to be prepared to make a hardship letter. I got a denial in the mail in 11/06 and did not know what to do so I obviously went to a Lawyer and she filed the appeal for me and did not really ask me for any Doctors notes or for me to make a strong hardship letter after a year went by I found out that the letter was not strong enough either. Well I went to another Lawyer and in 12/07 and she seems to be helping me the proper way the way that I've read that hardship letters prepared. But in my case I live with my parents and now pregnant with my yr old going on three and Diagnosed with delays and will be receiving several therapy including emotional CZ social worker indicated that the separation from his father affected him. I have a sister who is Down Syndrome and I'm her primary care giver and she has several heath problems and it is difficult CZ my mother also has several health issues and will be having surgery tomorrow and I'm that only one available to care for her she is diabetic and will be having total knee replacement. I cant care for a three and for my self. I am now going to therapy my self and in need for medication but Doctors dint recommend it Cuz I;m pregnant but if I dint get any help I will go crazy. I am stuck in a rough situation CZ I'm suffering threw major depression as well and at risk to have Prue-term labor I really need my husband assistant what can I do. HELP

Hi Lulu - is your appeal still pending? Has this new attorney mentioned getting a new appointment in CDJ and possibly abandoning the appeal? That will probably be better. Talk to Christytorres, Gaby, sdeb, etc in the I-601 Mexico area.

The Lawyer mentioned something about submiting a new appointment but in the situation I'm in I really need him cuz I my health concerns. I don't know how long another appointment will take? I know I have alot of hardship evidence this time, and my hardship letter I well prepared it with the help of this forum but my concern is how long it will take for a knew appointment and I don't really know much about the piolet program in Juarez.

Sorry forgot to mention yes my appeal is still pending.
Lulu from what I have learn in this forum , is much easier to request a new consular appointment than the appeal, in order to get a new appointment you need to drop your appeal.
I suggest you to read the Laurel forum from yesterday january 30th.
Many people here have done it, and they got approved in the second run.
Like Cristy Torres, Morena, mmartinez, sdbe, karenina, catiana and some other people than I can not remember.
Right now so far there are like 5 people waiting for new appointments like pinkbutter, desesperado, and I do not remember the other ones.
Nepthy Justo was denial too, but she filed MTR and she won.
So keep reading the post on the members I mentioned above and you will get useful information ok.

Thanks Gaby the Lawyer I'm working with know said something about getting a new appointment I read yesterdays forum but I dont if I should just call and scheduale a new appointment or go ahead and sent a letter requesting a new appointment like Laura said or wait for the Lawyer! I'm just really stuck on so many thing going on here at home and all I want is for things to go much faster. I read on the chat yesterday that it could take from 3-5 monthes for a new appointment right?

Hey when did you request a new appointmnet and do you actually sent it threw mail or call and request one?

Lulu - You will have to fax and mail request(s) to the consulate to get a new appointment. It can take a while and you have to be persistent. But once you get it you can work on withdrawing the appeal (which I believe christytorres had to do) and then get your hardship stuff together for the pilot program. It sounds like you have some good hardships so you shouldn't have a problem getting approved the second time around. Sdeb's husband is at his waiver appointment today (second try) so hopefully that goes well. So far everyone who has gotten a second appointment from this forum has been approved through the new pilot program.
hey lulu, since the system is down, I have request my new apppintment by fax and regular mail.
I have send around 5 letter so far, Hopefully will get anew apppointment soon

Hi Lulu, I know is hard, but there's no way around, you have to try to get a new appointment, there a lot of info here, probably in the I-601 Mexico area like Laura said..Be strong, and have faith...

Thank you very much but I'm filling kind of sad cuz my moms in the hosprital she had surgery this morning and seems like everything is fine but she is going to need to stay more then a week in the hospital and I'm home with my sister that has downsynrome and my son. I wonder if there is any way I can process this faster cuz my sister has several health issues and my son needs several therapys a week I really gonna have a nervous breakdown and I been having complications with my pregnancy.

OMG,...I don't know if you could probably talk to Mr. Burciaga or somebody else, your senator or congressman, I don't know, why don't you writte a thread under I-601 there will probably be more people to help you, you should do that, ok
I know it must be pretty stressing, but if there is no other way, try to be calm, God is always with us, only God knows why is this happening to you, but it will never be for a bad reason, think positive lulu, trust him.. God will help you..:)
I hope evrything comes up alright ok...

Hi LuLu, what eveyone has told you is the truth. I asked for a new appt. back in Jan 07, then I stopped because I had an appeal pending. I sent my Appeal in Nov. 06. We were denied lack of hardship. totally unprepared at our first Interview back in Jan 06, way before the pilot program. well I finally emailed them for the last time in September 07, and then I got a response back with in a few weeks giving me the ok to get another appt. I just has to wait. well Oct 16th I got my packet. Our appt. December 27th Wavier appt. on Jan 3, we were approved the same day..this site is who I owe it to. I did not use a lawyer. it will happen, Also I withdrew my appeal Nov. 14th..and was able to re-submit a New Wavier...keep the faith, it will happen..keep us posted..
