my husband was detained on 1/15 and has just now recieved his notice to appear for a bond hearing but its not until 2/5. that means he has to stay there almost 2 wks longer!!! any advice? Can u push up the hearing. i miss him and want him home where he belongs. thx

INS officer can fix bond for ur husban but normally its little higher if INS does. Why he is detained?

he is a canadian citizen and we are in the process of filing the papers, just waiting on a physical. we live in ca and he went through border patrol and asked him for his greencard but he only had canadian greencard and ss#. They "assumed" he "overstayed" his visit here which he didn;t...he left first week in sept and came back the 12. being as he is canadian citizen he is allowed to stay in this country for up to 6mths without being legal. Hes been here 4. Border Patrol doesnt care though. anyway i hired an attorney for the bail hearing but i hate to wait that long!! I emailed him to see if we could speed things up but im waiting impatiently for his response. any suggestions?? thanks for your time..

I believe I replied to you on your other post. You can call the INS and ask to see if he is eligible to be released on the initial bond so he can wait for his court date outside the jail.

The bond hearing is generally an informal hearing and it is not part of the removal proceedings. It is only to request the judge if the amount bond set by the DHS can be lowered or eliminated.

NTA or Notice to Appear is a charging document filed in the Immigration court and advises him about the alleged violation of the immigration law.

They are two differnt things.

i'm so glad I saw this topic!! I wasn't aware you could call and request this... I just called and they told me they dont have his file yet :( he was taken over to the detention center on Saturday so I asked when they would have it. She said any day now... so i'll be calling and asking every day! Gosh, he's been detained since the 6th! I miss him so much

rabbit- what number are you calling? I can't seem to get ANYONE from INS to talk to me. Maybe I just have a bad number...

My fiance is at the NW Detention Center in Tacoma so i'm calling their main number. One of the many times I called asking for info on him they told me I needed extention 17, so I called that one. I got the info from this site http://www.ice.gov/pi/dro/facilities/tacoma.htm
maybe you can find your facility there. The main number is just a recording with those, press 1 for blah blah, press 2 for blah blah and I just tried all of them until I got someone then I asked them who I need to call.

BTW... I just called and they told me he is not eligible and has to wait for a bond hearing which hasn't even been scheduled yet :'(
