Hi everyone, we are new to this site and this is our 1st post. Here is our dilemma and questions. My husband had his interview on December 27, 2006 in Prague, Czech Republc. We knew we would probably need to file I-601 waiver and had that prepared with the help of our lawyer. Technically my husband didn't overstay over a year and probably shouldn't have had to file for the waiver because it was already past the 3 year bar but they had us file it anyways. We feel that we have proven extreme hardship by letters from ourselves, friends, family and my wifes doctor and my step kids doctor. The embassader finally sent the package to Vienna, Austria in Janaury, 2007, which was received in Vienna on January 22, 2007. After our lawyer sent a 2nd inquiry on our case, they informed her that our waiver was sent to Frankfurt, Germany on June 12, 2007 for final adjudication due to backlog in their office and they said that it would get processed faster in Frankfurt. According to other post and websites we have seen, we saw that Frankfurt is rather fast and has a good approval record. Well we sent an email to Frankfurt today and they said they did recieve our waiver and it would be adjudicated within the next 60-90 days. This is WAY LONGER than what we have read. We have read that it normally takes them 4-6 weeks to process. Has anyone had thier I-601 approved in that office recently? Can you also tell me where they will send the approval (to my US wifes address and Embassy in Prague?)? Thanks!

Our waiver went through the Frankfurt in 2006. it took about 2 month. The answer that they gave you- is generic for everyone ( so people would not start calling or emailing them every day). I would say that Frankfurt go better because in 2006 they were not responding to the emails ( only if you are senator or other government official).
This positive- if they are taking more time to work on your waiver- it means that they can not find a reason for the denial. It was like that in our case. My waiver went to the Frankfurt, then 1 week later other person’s from the forum wavier went to Frankfurt. She got a denial letter in 3 weeks, we had to wait 3 or 4 more weeks to get our approval. So, hopefully, you are 1-3 weeks from the approval.
Do not give up, you are very close to the end of this!!!!!!!!!!!!!!!!!!!!!!!

~ditto~ with Member Ginger. :) Since mine was DCF and not a File transfer, it took only about a month. Well, I had to wait for another month for file transfer to DHS (ummm, like on the 2nd Floor! mind you...lol) and then the decision was like 3.5wks.
Btw, they gave me 60-90 days as well... :) So yah, standard reply. Even if you were to make a phone call, same, 60-90 days reply.

Thank you very much for your replys. I pray to God that our waiver don't take to much longer. We still have hope and faith. Again, thank you very much for your replys!

My experience with F'furt, they sent it to me, the Alien. So, they could be sending the approval letter to you a.k.a Prague. :)
All the best and keep us posted...

Well we had my local congressman send an inquiry to Frankfurt regarding our case and come to find out that Frankfurt didn't recieve our I-601 package until July 20 (over 5 weeks since it was mailed from Vienna, Austria on June 12). They said that thier processing times for I-601 were approximately 60-90 days. So now we know for sure my hubby wont be on the plane back home with me. We are just praying that its approved (and we feel it will be) and that it wont take the full 60-90 days. But again, I would much perfer to wait and have a positive reply than to be denied.
Has anyone else had any recent dealings with Frankfurt, Germany or Vienna, Austria? I heard that Vienna has a hard time keeping an adjudicator and often sends out cases to other countries. I also heard that they are pretty good at maintaining their 6 month I-601 processing times. So who really knows.
Please keep us in your thoughts and pray for us that it wont take much longer and we will have our approval! Thanks everyone!

That's good to know that it IS with F'furt. That's good way to look at it and stay positive, Kerri. Continue to hang in there.

Thanks Pinkpig and Cynthia. It sure is hard waiting, but that is all we can do right now. Most important thing is that it gets approved!
