I've been reading lots of things about immigration and I've come across some saying is you have over 2 years of probation then thats equal to a aggarveted felony, is this true or something of the past or what? Without the probation the max of the original charge was 6 months and the actual charge plead to, max was 45 days. But they gave my husband the chance for probation for 36 months. Which he violated by driving again and had to do the 45 days. I'm wondering if this is true about the probation thing though.

what kind of probation is it? is it court probation? My fiance has a court probation for 3 years but not sure. All his court papers have is as a misdermeaner class A...
He had a DUI...
What was the reason your husband was not suppose to be driving?

accident. he never had a license anyways, but some i read that they can't have a certain time of probation or it equals an AF. but then i read that its better to get probation. I'm confused. his was he either had probation OR jail. I'm thinking this is the difference. I think they mean if you go to jail for x amount of time and then still have probation upon release then it could be an AF. maybe..?

Oh so he got a probation for driving without a licsense.
Wow they were strict on him...
They usually only give tickets for those...
Did he hurt someone while driving?

actually, his friend drove his car and got in an accident and ran away, and since the car was in his name, they gave him a charge of hit and run and driving without a license, even though he wasn't in the car. so he got probation for that, and it was revoked because he drove again.

Sorry I am not being much help but now its making more sense.
That sucks what happened to him...did the accident cause any injury because maybe thats what could of made it a felony.
