Earlier I had posted waiver for friend of mine (from India) which he was denied by INS not enough hardship later he appeal the case and he was approved on Jan 08 I saw the case status on line it says his PR card will arrive with in few days I am so glad he got approved so he did not have to leave country anymore it took three months after denied from INS to get approved.
I am still waiting for my case to be adjudicated along with waiver I am from Pakistan since his case got adjudicated It gave me little hope to get approved will see.

Congratulations on ur friend's approval. Also hope and pray your waiver be approved soon. I got couple of questions, if you dont mind.
My friend who is also an Indian would like to try an in-country-waiver. My question is;
Did your friend use a lawyer?
Could you pls give me some background about your friend's case?

He was deported back in 1995 for assylum case but never went back home he have 4 USC kids along with his wife. He applied for waiver/485 back in 2003 INS denied his case and he appeals and they approved his case. He just recived his GC. yes had a attorney. Long journey just like mine.=)

No it took 4 years to deny his case and he appealed 3 months ago.

I thought appeals take 18 months or so?
It took him only 3? How come?
I am just trying to prepare myself in case we get denied

I believe he applied for residency back in 2004 he involved several congressman for us case and finally last year they response with rejection his waiver and 485 so technically he waited three years for decision including (485.130/601) is this a normal time? then he appealed his case to information ins provided to him and when he appealed it took only 3 months to get approval.
I am also wondering how long will it take mine also I interviewed for all (130/485 and 601) back in jan 07 and still waiting for decision how long have you been waiting?

since we sent the package to INS (130, 485 & 601) it took us five months to have an interview which we had in january 2008. The officer who interviewed us told us that our case is pending and that he will send us a written decision within a month. (not sure if this is true). So here we are waiting. But 3 years I believe is such a long time. Maybe your friend had some other things that had to be resolved in addition to adjustment.

kkalan: have you sent the package together or piece by piece. I am not sure but I heard that if you send the I-601 by itself it will take time. Why do you think your case is taking this long? Did you have any problems? What did they tell you at your interview?

After the interview in Jan 2007 I was missing several differant paper work I was missing my passport pictures Medical exam failed due to TB issue but later County hospital clear me, They also asked birth certificate for my son and Labour certifcate: after 6 months when we send them all information that we were missing we mailed them and later when we ask for updat they said awaiting back ground checks ad still no response even though our interview happened in Jan but I am assuming clock started when we submitted all documents which is some where in mid year

Congratulations. From what part os US did ur friend filed that I-601? Am preparing to file my I-601 too. Getting ready.
