View Full Version : So We're In Removal Proceedings....??!

So my hubby is in Removal Proceedings and we have our Master Hearing in July now....

From what I have understood so far....he is EWI from MX and we filed our I-130 in NOV '06. I checked my packet to make sure that he wasn't trying to adjust here...I really didn't put Ciudad....

LOOOOnnnngg story short...now we receive a letter saying he is in Removal Proceedings now.

What normally happens at a Master Hearing? Will they give us the opportunity to say that we do have an I-130 that is waiting to be approved? I also noticed that we need to get hubby fingerprinted within 30 days?? What's that about?
I also hear people talking about a bond? I am soo lost! :D

Were there any deportation notices issued against him prior to you filing the I-130? I am sorry this happened. That is why most attorneys will tell you not to go to an I-130 interview. If you are called in for an interview, just leave because you will be put into removal proceedings. I am so sorry. You can always ask for voluntary departure from the Judge and this will buy you some more time before your husband has to leave.

The immigration judge will ask your husband or his representative whether he qualifies for any relief.

Will they give us the opportunity to say that we do have an I-130 that is waiting to be approved?

There are some judges who will continue proceedings while a resondent is waiting for an iv interview overseas, but it isn't anything to count on. Depends on the judge.


I also hear people talking about a bond? I am soo lost! :D

In my experience, bond is only a payment you make when you are detained by I.C.E. and pay the amount determined by ICE or, if you request a bond hearing, the amount determined by an immigration judge.

I have heard of others going in to their local office for an I-130 interview before...based on showing that their marriage was legit....and nothing like this happened. They went on their way with the approval of the I-130 and and already finished this whole mess....

Yes, it does happen. However, please be aware that it will depend upon the mood and circumstances and that you should always be careful because it can and does happen.

Now Caribbeanman if I read correctly though, you had a visa in the first place right? Were you able to adjust here in the states?
See I think you gathered that my situation is a bit different...my hubby entered illegally and never had the visa in the first place...so technically he still needs to go back to MX.
Maybe you will be lucky enough to adjust here in the US totally!
