Forms Questions...

I had a some questions on how to answer some items in 2 different forms, and I would appreciate it if anyone could give me reassurance that what I'm thinking is the right thing...

Here we go:

Form I-130 – I will become a citizen in 3 days (yay!), so and I’m preparing the paperwork for my husband… under the first part of the 130 form, I’m supposed to be putting down information about myself, since I am the petitioner.
When it asks for my Alien #, should I put down my green card #, even if as of the date of that form I will no longer be a resident, but a citizen??? What I’m thinking is, I can’t just write N/A or NONE, because I did have one… and even if I don’t know that specific answer, I’m thinking I will put it down, as I think it can’t harm it…but if anyone has another take on this, I would certainly appreciate it!

Form I-130 – Item 19 (Address outside of the country): My husband hasn’t lived outside of the country in almost 5 years. Should I put down his old address anyway? Or is this item there just for those petitioners with relatives outside of the US (who are not doing AOS like my husband)?

Form I-765 – This one is just double checking… Item 9 asks him to list a SSN he might have or any other he might have used… he has used one that was not his own, so he should put it down anyway, right???

I would wait three days and then fill out the form. You won't need your A number at that point.

Did your husband enter the US legally? Are you adjusting his status from another legal visa? If so, there wouldn't be any reason to put an address outside of the US, but I would recommend double-checking with Laurel Scott on her next chat. (www.visacentral.net)

Illegal work is *usually* forgiven when the person is married to a USC. That said, you are also required to tell the truth on all forms. Might be another good question for Laurel's chat to be sure.

I agree with kitkat on waiting 3 more days before filling it out.
I wouldn't put down the ss number.

We didn't put down the fake SSN either and it went okay.
I don't think you need the A# if you are a citizen. But it may be put down just as an "extra" tidbit of information.

We did include the fake social. I was more afraid of getting caught lying on the forms than using a fake number.

I am definitely waiting until Monday, since even if I wanted to, I wouldn't be able to send it before, as I need to include a copy of my certificate. When you said: wait 3 days, did you mean after I become a citizen, or just because when I wrote the message I said I would become one in 3 days?

Anyway... does anyone think that it would be a problem we sent the paperwork the same day (my ceremony is at 10am, so we're thinking of mailing the paperwork later that day...)

Congratulations to you that is wonderful!!

This is my opinion. I always recommend that anyone who is beginning an immigration process needs to have at the very least one consultation with a trusted immigration lawyer because there are little things about immigration that can cause huge problems. Typically if you are going to have a problem you find out after the fact. Sometimes even after a consultation.

Our lawyer filled all of our paperwork out and I have never filled out any of these forms.

I don't know anyone else who has filed for their spouse after becoming a USC.

I am thinking that you need to put it down as you do have an A# and you do know what it is and they will also have all of that information. So in order to avoid any hint of misrepresentation I would put it on there. It should not have any implications for your petition for your husband as you will be a citizen and you have different rights as a USC. So IMHO yes, I would put the alien # on the form.

Does he have a current valid mailing address out of the country? I believe this is meant for an address for those who are out of the country. I believe this is meant as an address where forms can be sent to anyone who is applying out of the country.



I believe that you need to be perfectly honest on all of the forms...so if he used a SSN then I believe he needs to put it down.

I don't think that immigration checks SSN's.

I am guessing that he used a number that he made up or was fake. I am guessing that he does not know whose SSN it is or it is fake.

And I think that working without authorization is one of those things that is forgiven with marriage to a USC.

I am of the opinion that you need to be perfectly honest on your forms.

I think you can file the day you become a citizen. I think I would put a picture in the packet of that happening. :)

I really don't like to answer questions on PM's as I am concerned that something I PM may be wrong.

I also don't like to answer questions that I am not 100% sure of. That is why I have not chimed in on your thread.

So when my answers are posted here in the forum others have a chance to correct my errors and also to chime in with their opinions.

This is one of the strengths of this forum...so many different experiences...
