Hello there... I just found this website while doing some legal googling, and thought I would post a shout out for info. It seems like most people here are or are married to/sponsering Mexicans with illegal alien status or who illegally entered the US. My husband is from Brazil, and entered illegally about 6 years ago now. We have been married for almost 2 years, and have an 8 month old daughter. Does anyone have, or know someone who has had, firsthand experience with filing for visa status and the 10 year bar waiver (for those who entered illegally into the US) from Brazil? Has anyone been successful in getting their waiver approved there? If so, does anyone have examples of the basis for EXTREME hardship? I would really like to start the process of helping to get my husband permanet residency status, but the prospect that he could be barred from re-entry to the US for 10 years once we return to brazil for his interview is VERY daunting. We had been playing the wait-and-see game since the immigration bill had been in the senate, but know that the Bill is dead for the forseeable future, I do not want him to live with this huge shadow looming over him for the next 5 years if its avoidable. JennIsabella welcome you have come to a very good place for answers to your questions. The people here are very knowlegable and helpful. I am still learning and don't want to give you the wrong answers, but others will start giving you help soon.

Welcome Jenn - I know I have already talked to you, but again Hi and welcome. If you look under the General Discussion group there is a thread on Family photos I started there is a girl in there and her husband is from Brazil too. I do not know haw far in the process she is, but you may want to ask her.

Welcome Jenn! You are in the right place. Definitely people have had waivers approved through Brazil. Member Pinkpig has a very good spreadsheet that lists all the members, where they filed through, and their dates. If she doesn't pop in here, you might want to search her name and send her a private message. Her Brazilian daughter-in-law also went through the waiver process and was approved, so she will have good information.
As far as the extreme hardship, check out the stickys in the waiver-I-601 forum, the approved hardship letters in both the Mexico and other countries area, and perhaps consult (for $100) with Attorney Laurel Scott, who specializes in the I-601 waiver. There is a lot of information in this forum, so welcome!!!

Many have been approved through Brazil/Lima. There are a couple of hardship letters from Brazilian members in the HSL sticky. Graziano, Eve, A-train and others. If you are looking for a lawyer, I highly recommend ours, link is in my signature...tons of information on her website...take the time to click around there for information. Tons of information here on I2. This is the premier site on the internet for help with the waiver process. You have found the right place.
Here is the US embassy site in Rio, Brazil, where your husband will have his consular interview and be told if he can file the waivers. http://www.embaixada-americana.org.br/index.php?action=materia&id=2413&submenu=rio.php&itemmenu=58#pet The waiver package will then be sent to Lima, Peru for processing. Actual time to allow from the first consular interview to being back in the US is roughly 12 months, if everything goes well.
