Hi all,My waiver i601 has been denied at Rome.Now i would like to refile,but i am not sure if Rome accept refiling or filing a new visa petition(i130) all over again.Anybody have any idea,please let me know.:innocent:

Please help me,I got my denial notice very late.I have only one week left to file my appeal.I know that it is better to refile than an appeal, but i don't know whether Rome accept refiling or not,or i will start all over again by filing a new visa petition(i130).If anybody have an answer please let me know.I submitted my waivers (i-601 & i-212) at Islamabad,and after 10 months Rome denied it.

Hi helpless. I don't have an answer for you. Knowing you only have a week to appeal, I would be looking for a great attorney or call the embassy. Hopefully, an appeal is not your only option. Best of luck.

Just an opinion here, but if I were in your position I would gather a huge stack of documentation regarding current Pakistan political turmoil as it has turned much more dire since you filed, strengthen the logic and documentation for the hardships you have already presented, post your letter here for a critique, and refile. Does your denial letter give their reasoning?

I have to agree with Jpaula....and Lyro07...

I would be calling the embassy where you filed your original waiver, and I would be calling the best waiver immigration attorney that you can find (Laurel Scott).

I know that the OIC of adjudicating waivers in Juarez, Mexico has confirmed that you do not need a new I-130.

You should be able to re-file based on new hardships (Pakistan dire circumstances and whatever else you can come up with that answers their reasons for denial).

You will most probably need a new appointment to file the new waiver and a kick-butt waiver package. You will need to file a new DS-230 at this appt.

You should be able to use the denial letter to get clues as to where you need to beef up your hardships in addition to the circumstances now going on there.

IMHO: filing an appeal is a waste of time. You just need to do whatever they want you to do to get an appt to file a new waiver based on new hardships and it needs to be the strongest you can muster.

Thank you for your replies guys.I am e-mailing the embassy today,because their phone is always busy.Rome sent me a very long denial letter,but at the end it says "In light of the foregoing, the application for waiver is denied because the applicant has not demonstrated that the denial of his waiver would result in extreme hardship to his United States citizen spouse".From your replies i found out that i need new DS230 not a new I130.Is that right?
