View Full Version : I130 aproved - Could Anyone Else Tell me what to do know?

Wife EWI (entered without inspection) from Guatemala to USA.
Married in Oregon, had kid in Utah, and moved back to Guatemala in April.
I-130 approved in July.
Does any one know what to do next?
I think we have to do biographical info, and affidavit of support?
Eventually my wife will apply for a VISA. Chances are her VISA will be denied for illegal entry. May be not, I have heard visas are now being givin away a bit less strict?
From there I apply for a I-160. When do I do this? Do I turn this in to Guatemala Embassy, or US?
I would love to get some feedback.

You are correct - the next step is to wait for the next set of paperwork to be sent from the NVC. This should arrive in a few weeks. The first thing will be the choice of agent forms I believe. From there - everything rolls smoothly, hopefully - future forms from the NVC include the affidavit of support and the biographical forms. Upon completion at the NVC - your wife will receive an interview date. I am not familiar with Guatemalan processing times, so I can not tell you how long that will take. Hopefully someone will answer that for you. At the interview, in Guatemala, is where your wife's visa will be denied. After that is when the waiver is filed. It is the I601 - and I dont know if that was a typo on your part or confusion. I just wanted to clarify.

Guatemalanlover: Welcome back to the site. After reading your post, realized that you are going through exactly what my daughter is going through. Her husband is from Guatemala. They will be filing their I-130 soon and I think that will take about 6-9 months for approval. After that, package will be sent to National Visa Center and he will await for his appointment date at the Consular's Office in Guatemala where he will be denied. He then will file his I-601 and we will wait to see what happens. The Consular's Office in Guatemala has told us that it takes about 6 months for either approval or denial.
Just curious: Why did you move back to Guatemala in April? Why so soon?

Thanks to you all for your help. I have filled out the choice of agent forM which was the first thing to come in the mail. Now they sent me a packet and before I can do any thing I have to send a visa processing fee. I think it is like $70 or something like that.
I need to call my parents and see what needs to be filled out. I think it is the biographical info, and the affidavit of support?

What is an I-601? NVC has not told my husband that he needs to file an I-601. My husband has 8 months in Guatemala, and when I called on August the NVC rep said that we need to wait for the interview, but never mentioned the form I-601.
May you give me a little of info regarding this form?

The I 601 is a waiver - and he would not be told that he needs to file the waiver until the interview at the consulate.

YRuth - Was your husband previously unlawfully present in the U.S. for more than 180 days? If so, he needs an I-601 to avoid the 3 or 10 year bar and get his visa. Read the link in my signature under "Need help...."

True, but if you know you will need the I-601 anyway, it's much better to have it prepared in advance.

Why do you need to apply for an I-601? Can you tell me ehat this form is for?
