if you recieve an order of deportation as a minor and never left, will that affect approval for my waiver?i have to file two waiver one for being here illegally and one because i have an order of deportation, well it was voluntary departure but i never left because i was like 11 years old and may parent didn't want to live. now i am married to a us citizen and filled for me and my order of deportation was given to me back in1997 , 10 years ago to be exactly.

Hi, I am going through a similar process with my husband.
1st Do you know EXACTLY what day the order was issued as 1997 is the year that IRIIRIA ( immigration reform) went into effect and if you were ordered removed before it went into effect it is a HUGE difference.

When you say illegally, do you mean you Entered without inspection?

Yes, it will affect the waivers. Since you did not follow it, and you are now an adult you have begun illegal presence time. Had you left before you turned 18 and then applied, I think it would be different, but now the voluntary depature has expired and would probably now be a deportation as soon as you go to the interview proving you're still here. You're probably going to need help on the 601 side too.
You will probably have to file both 212 AND 601. BUT, how did you enter the U.S.? Someone else will probably chime in with better info...

Hac - the only difference is that you will need an I-212 in addition to the I-601 when you eventually have your consular interview. Did you EWI? Also, what country are you from?
Wow Laurel, what time are you getting off from work, is almost navidad and since you have a mexican husband, you know we celebrate the christmas eve.

Haha... Gaby - I wasn't working when I wrote that message. I was off at noon, but then I was baking and cleaning and wrapping presents... stopping by at I2US here and there... yes, we are having a little party at our house tonight after everyone gets off work.

well my parents brought me i think they entered illegally? Can i file both of the waivers through the pilot program? are they approved or denied at the same time or do you wait for each of them to be proccessed?

I am from mexico and i have entered the US ones when i was like 3 and have never left even though i was granted voluntary departure 10 years ago.
