View Full Version : After the court will they transfer my case back to

I went to court on sept 26 for removal proceedings. My lawyer took care of this and the judge terminate any removal proceedings, because I file I-485 adjust status on jan 07. Now my question is will the court transfer case back to the inmigration dept since my I-484 still pending since jan07.

My lawyer keep telling me that they have to transfer my case back but is been almost 3 months since sept 26 and I haven't heard anything.

The judge give us a letter saying that removal proceedings are terminate due adjust status before court. What else do I need to do should I keep waiting is my lawyer telling me the rigth thing . This waiting is driving me crazy .

Please any advice. Thanks

I forgot to say that on march before I went to court I already went to did fingerprints and interview for adjust status

Yes you no longer will adjust your status in immigration court but USCIS will now adjust your status...this may take some time as i was in immgration court also but the Judge "administratively closed" my case because i have a pending i-130 but my case is not totally terminated because i will have to re-calendar the case when my i-130 is approved and then adjust status through immigration court.....personally i think adjusting through immigration court is faster because the Judge makes his decision immediately.You can call USCIS and ask them about your case.

Maybe it's taking a long time because they got to schedule an interview for your I-485

Yes Caribeanman I agree with you adjusting through immigration court is faster because the Judge makes his decision immediately, but on my case for some reason they send me to court after I file I-485 and went to the interview the letter that I got was on removal deportation due you enter illegaly, but on court I have my passaport with visa and I-94 the enter legally .

Then again the court will transfer my case back to uscis will adjust is that correct. Thanks and good luck for you .

The interview was base on my marriage and my lawyer went with my and my wife and he did not ask much, he did not give answer he told me that he was waiting for another file. But two months letter I got the letter to go to court for removal proccedings .
I only went to court one time and my lawyer told the judge that It was a mistake and my case was pending, it only took 5 minutes for the judge to terminate removal procedings

So they didn't tell YOU anything about if it was pending or if they had made a decision?

That "other file" you mentioned is your A file once your are in removal proceedings they have to have your A file to conduct the intervew...i hadthat same problem with the local office when they were surpose to hvae my i-130 interview they had to request my A file.

No my lawyer told the judge that my case was pending with the uscis but as for now no I haven't heard any decision has been made yet

Yes you are correct , but I never got letter to be on court

Yes I was on removal proceedings before I went to the interview but like lawyer told me my case never got to court he check before and also I check myself and my removal proccedings never make it to the court before the interview

Ok well seeing that your removal proceedings is terminated you will have to direct all inquiries about your case to USCIS....call the 800# 0r make an infopass at your local office to find out what's going on,why are they taking so long.

Thanks Caribman and yes My removal procceedings are terminated my lawyer keep telling that it takes about 3 months for the court to transfer the case , my court was on sept 26 so 3 more days will be 3 months already. But If I don't hear anything I will go back to my lawyer I paid a lot money to him and he is the lawyer of the stars here in los angeles he got the green card for salma hayek and other stars. But once again thanks this process drive me crazy

Ok but i wols suggest that YOU do your part and call,remember the lawyer DON"T always think about your case all the time as you would so i would go to the local office AND call the 800# trust me on this i've been there before.

I'm going through a lot with my husband who is detained in el centro and my attorney told me we will go through the same process you are. everything sounds familiar and from my experience is just takes a very long time!! be grateful your removal proceeding were terminated. Out of curiousity how did this all come about? where you detained? best of luck to you
