View Full Version : Boyfriend was arrested by ICE

So basically, my boyfriend is illegal (he lives with his LEGAL brother) and he took his nephew to court yesterday (his nephew had issues with his step-father, had to go to court) and he was waiting in his car and they came out to where he was sitting in his car, asked him for his liscense and he said that he didn't have it. They asked if he had his papers and they took him inside the court and arrested him. They placed him with 50 other guys in a room but they let him go (I guess because they didn't catch him in the street or because his legal issue is being illegal, but not anything else like robbery, traffic problems, etc.) SO, they gave him an order of release on recongnizance and he has to appear before a judge to state his case in about 3 wks. Is there ANY way they will not send him back or is he pretty much bound to go back?

Would it be of use to get a lawyer??

I know a guy that the same thing happened to him and he didn't have to go back because they were more concerned with the people out there that are dangerous causing problems.[/SIZE]

How did they know he was there or they were just passing by cars asking people for drivers licenses? I just dont understand if he is sitting minding his business what the problem is....what is this world coming to? Why all of a sudden the harsh reaction to illegals they have ben here for years why now is all of this coming to a head?

It is coming to a head now because they are trying to change the laws (all for that) and it has been the highlight of the media. Whatever is in the news get BIG reactions.



As for the boyfriend, I would get a lawyer and at least try to get voluntary departure.

Whatev - how long has your boyfriend lived in the U.S.?

Are you in a serious relationship? I mean, have you considered getting married, or not really there yet?

I don't know if there is really anything a lawyer will do other than delay the deportation if that is indeed what his court date is for. He will hopefully be offered voluntary departure because he doesn't have any criminal issues, but you can't fight it forever.

If you are serious you could file a fiance petition for him, but he'll still have to leave the U.S. for a while...
