they usually send you a letter with an appointment for fingerprints and they do the check.
What are you filing?

I did file the I-130 and it is pending as of 3/07.
I need the FBI Check to make sure that he wasnt deported.
He EWI in 2000 and got stoped and fingerprinted. But he returend to MX voluntary.
If we have to come in as u say, come in where ? Are there local FBI's ?
Wouldnt they keep him in order to deport him ?

I did some research.
In order to get your background/fingerprint check at the FBI you have to :
get your fingerprints at your local LawEnforcement or UPS :).
Then send it of along with 18 $ a copy of ID and a cover letter to
US TREASURY
FBI CJIS Devision

As I mentioned to you in another post mymexicanman - you may want to do a FOIA (freedom of information act) as well. This would also show if he were deported. Our lawyer informed us that sometimes those records don't always make it into the FBI database.
The downside, is that you have already filed the I130 - and it will more likely be approved before your FOIA would, as they take about a year to complete.
We are in the same situation as you are - although we filed the FOIA in sept/2006. We decided in May to go ahead and file the I130 and not wait anymore. However - we did an FBI check in January and that came back 'no record'.

I wish that I could get a FBI check on my hubby just to know what's on his record. We are already biding our time trying to show proof of rehabilitation. My husband had 2 1st offense DUI's back in 2004 and 2005. Then in Jan 07 there were 2 domestic (because of alcohol). Since then my husband has been wonderful. Alcoholism runs in my husband's family. It was definitely something hard to overcome for my husband. He's benefited greatly from his counseling that he's received and in September the domestic will be completely dropped. I'm just curious what all goes to the FBI. I've heard different people say different things. Some say EVERYTHING goes to the FBI as others say it depends on the nature of the crime and what kind of sentance a person received (if convicted).
My husband had a car accident in 2005 and since then hasn't had an ID because it was lost in his accident. At this point, I sure wish he had one because I REALLY want to know what's on his record and what we're facing.... I don't know....maybe we can figure out something.

deborah - you could go ahead and do the FBI check - anyone can do one at their request. Just follow the instructions that were posted previously - and you should be able to get your copy!!! :)

I think we're going to go ahead this week and get them done. My only problem is.....I've tried to get the "Cover Letter" to pull up so I can print it off, but it won't load. Ya'll have any ideas?
Also, have a question....what if it happens to come back with no record? I mean, I know my husband has 2 1st offense dui's, but what if the police stations never turned them into the FBI??? And the domestic, well.....it's being dropped in September, so I don't know if it would have already been turned in or not..... If it does say no record, I might risk it and go ahead and preseed with the process... What do ya'll think??? I mean, whatever I get back from the FBI should be the same as when immigration pulls his prints right?? Well, who knows....I'm just babbling now and getting myself even more confused....LOLOL!!! I'm just goind to take it one step at a time.
If ya'll can find anything out about that cover letter I'd sure appreciate it. Thanks bunches!!!

The fingerprints do not need to be done at a local law enforcement or UPS - you can even do them yourself with a stamp pad and ink pad. It takes about 5 months. If you know that your husband was stoped and fingerprinted, but returned to Mexico voluntarily, then he wasn't deported. Sounds like catch and release and while the attempt may have been recorded, it's unlikely to show up on an FBI report (many don't show). Either way, if he was officially deported, he would know it. So while it's not a big deal to do the FBI fingerprint check, it doesn't sound like you even need to bother with it.

We did our FBI check at our local Catholic Charities. I didn't want to go the local police station. It took about 20 minutes. They did everything including the cover letter for the FBI. Very easy experience!!

If he has a record for the domestic arrest than it will show up on the FBI even if the charges are dropped. It will show as an arrest. What you need to do is to go to the courthouse where the case is at and get a certified copy of the disposition stating that the case was dropped. They should have a courthouse seal they emboss on the paperwork that you can enclose in your waiver if needed or for your appointment. Just make sure you get a couple copies of the paperwork certified incase they want a original and then you can have an extra.
Good Luck!
