I live in TN and want to marry my boyfriend of 2 years. He is an illegal from Peru and currently runs a restaurant in NJ (which his father left to him). He has been here for several years!! I have checked into the requirements of TN for obtaining a marriage license...not gonna happen according to them. They say they need a valid license, which he has from the state of MD, but they say it will not pass because he is not a citizen and does not have a valid social. Same info from NJ, and MD. Does anyone have any info about how we can get married without penalty of law?

Did he enter illegally or overstay a visa? I'm going to move this to the waiver section for other countries.

There are several states where all you need is a valid ID. I know others will chime in.

Kelly - Check with some other municipalities. I married easily in Milwaukee, but I recall that other people have had a similar problem. Start calling city halls and ask about their requirements for marriage licenses.

While you are at it, you might want to read the guide in my signature to get an idea for the process you are eventually going to begin.

At least in Wisconsin, it's not a state law, it's municipality by municipality.

Kelly - did you check with your local courthouse to make sure you can't use any photo id, or did you just call the state? States don't issue marriage licenses.. but I'm sure someone from one of those states will chime in, I know they are around...

Tons of people here are married to undocumented immigrants, so it's definitely possible!

we got married in upstate ny and all we need was my husbands bc and we got our marriage licences with no problem.

How about Virginia? Here is the link to Fairfax County website. You only need license, passport, etc. to prove you are at least 18.

We got married in Indianapolis, Indiana. No BC's needed (just valid ID.)

yup Virginia is close to you and just requires valid ID like a passport or license, doesn't matter where from.

Raeford County NC- only have to have pic id and sign a form saying you don't qualify for a SSN. Also you can get married 24 hours a day! (Right Noelle?!?!?!)

I hope your not telling them that he is here illegally. I'm surprised that his drivers license wouldn't be sufficient enough. Otherwise his passport should be able to prove his age and idenity. It shouldn't be that hard to obtain a marriage license. Good Luck!

I know that it is far and it has been a while (we married in 2001) but in FL all you needed was a pic id! Myhusband used his ID from Honduras!

In North Carolina my husband had to sign a form and take it to a public notary stating he didn't have a ssn, I even downloaded the form from the website, my husband took his passport and that was it for us

In Atlanta all you need is a valid ID and his birth ceritficate (original and translated version). He will have sign a statement that he is not eligible for a ssn.

I don't see how they can legally require a ssn, there are those that travel here on vacation and get married spur of the moment (they don't have a ssn).
