Hi guys,
Please help me ,
Is there any way to apply permission to Enter as nonimmigrant visa?
If there is any way to come to USA and bring my baby with me to Seoul.My husband couldnt bring him, because of his job. There is no way to get him.

I'm assuming you hv to do waiver? If so, I'm sorry :( The NIV is not possible.

I think there is no way to get a nonimmigrant visa. You will need to talk to a lawyer to inquiere some Humanitarian parole, but even then I think it is not possible. Do not waist money on an attorney that will assure you a non immigrant visa. In your condition you will need to wait for your waivers to get approved.

NIV IS POSSIBLE THERE IS SEPERATE WAIVER FOR THAT 212(D)(3) AND IT COVERS ANY AND ALL INADMISABILITYS overstay depotation,medical criminal etc etc onlything it dosent cover is terrorisam and some securit stuff
so look in 212 forum

There are 2 caveats to the NIV waiver, first it can take up to a year to get a response on the 212d3 waiver and second since an IV petition is already approved, it will be a big hurdle to convince the POE and even the interviewer at the NIV interview that the person doesn't have immigrant intent in order to get the NIV.

im confused maybe its my medication can someone explain to me filing an 1-601 is that to remove the bar and filing 1-212 to reenter with temporary visa ? im confused someone help me

Don't confuse a reference to 212d3 as the I-212. One is a reference to the INA (212d3) specific section, the other is a USCIS form (I-212).
The I-601 is a USCIS form used to ask for a waiver of any inadmissibility for which a waiver is possible. The I-212 is used to ask for permission to renter after a prior deportation. The I-212 is only needed to be filed if you were previously deported.
