OK, I got my approved I-130, and just got the Choice of Agent form. Here's my dilemma. I'm in the process of consulting with two attorneys about whether I have a very strong case (no medical hardships to speak of). I just can't bring myself to send my husband back home if I'm not feeling pretty good about an appoval. Isn't there a point where I can delay this process? Like, after I send in my affidavit of support, I don't think Brazil will schedule the interview until we have let them know that we have all required documents for it, right? I'm wondering because ideally, we'd like to save enough money so that the baby and I could wait in Brazil with my husband. I can't imagine being here away from him, and don't even know how I would afford it.

These are the decisions we are trying to make right now, so any input is appreciated.

EWI, no criminal history,no misrep., just one entry almost 4 years ago.

Bumping up to clarify my question- If I send the aff of supp. payment in and the choice of agent form back now (I just got it), is there still a point where I can stall the time before my husband has to leave. We've almost decided that I will go wait in Brazil with him, but will need at leave 4 or 5 additional months to save enough money to support ourselves there..I want to time everything so that his interview is not scheduled before we have enough money.

Arodrigues - I think if you don't send the choice of agent that will effectively stall the case. If you send that, I think you will still be able to hold the Affidavit of support or the DS-230, which will slow down the case.

If you send everything all that stuff, you will be scheduled, but you can probably postpone if you are still not ready. I'm not sure if it's a different deal postponing in Brazil compared to postponing in CDJ though... for CDJ you just miss the appointment and then call to reschedule. If you are scheduled too early, you could probably just call the Consulate there and see how you can reschedule. Rescheduling may take up to a year though, so it's probably best to just slow everything down by not mailing one of those items in right away.

ARodrigues, we are in pretty much the exact same situation. I'm a little further along than you in that I've sent off the Choice of Agent and Affadavit but we're stalling on the last forms - the DS-230. I don't have any major hardships either and now that we're at this final step in this part of the process, I'm feeling scared about sending it all in and sending my husband back to Honduras. I have not been using a lawyer but am thinking about waiting until I can afford one to do the I-601.

I don't know exactly how long you can wait. I want to say one year but I'm not sure where I'm getting that from. Anyway, if you just need a few months, you can take your time with those forms and you should be fine. Best of luck to you!

How about this question:

If I go stay with my husband in Brazil after I've turned in my waiver packet, could that harm my case at all? Do I have to prove that I still have my income before he can get the visa (assuming he's approved). If I have gone to Brazil, I will obviously not have my employment at that time..
