View Full Version : I-601, I-212 approval in Ghana

After reading several sites, I have found little information on approval rates through Ghana. Currently, there is no Chief Officer and I have been told that all waivers are being adjudicated in Rome. My husband is currently appealing with the BIA and our lawyer anticipates a rejection. We have an I-130 already approved, but we need to file an I-601 and I212 once he actually leaves to Ghana. I'm currently gathering great information from your site and I truly appreciate the hardship letters that are being posted. Thank you so much for taking the time to post these. It gives the rest of us facing the long painful process an idea of what we need to do.

I have been told that we should either two of the following when he has to leave to Ghana.

1. File an I-129F
2. Report to Consulate
3. Attend Interview and let them know he is inadmissable and submit I601

or

1. File I-894
2. Report to Consulate
3. Attend Interview and let them know he is inadmissable.

Any information anyone has about this process would be greatly appreciated.
We have two very small children and are trying desperately to stay together. We have been married for 6 years.

More information is needed.

Is he in the U.S. now?

Did he enter the U.S. legally (what was his status)?

If he's in the U.S., why does he have to go back to Ghana?

He is in the US now.
He is under a final order of deportation for entering illegally and not disclosing how he entered US during his greencard interview. Complicated story.
He has no criminal record, has worked at the same job for the past 11 years. He is a model "immigrant". We just would like as much info. as possible before he actually has to leave. His case is under appeal with the BIA 6th circuit (very conservative). We are only trying to prepare the best waiver possible. Any information you have would be greatly appreciated

I have no Ghana specific information, someone else will chime in with that, however,

it sounds like you will be getting visa application paperwork to have an appointment with the consulate too soon for an I129F to help you, they are taking a while to process now too, and if the 130 is already approved there is no need to file the I-129F.

At the interview, they will tell you what to do next, but given your situation, you obviously need to have the I-601 and I-212 ready. As for the I-894, I'm not sure what this is, but your next step appears to be the interview.

Make sure that all information is reported this time so that you can keep a clean slate. But, for certain, they make the decision on inadmissible or admissible, you just give them the facts.
