I have made this forum my 2nd home since I discovered it about 2 or 3 weeks ago. After the first week of reading and reading, I thought I had a very good idea of what I needed to do. Now I think I've read so much that I've read my self clueless!!! :bounce::dunno:
Well let me fill you in a little on the situation. My boyfriend EWI approx. 4/2000 and has been here since. We have been together since 9/2003. He has been caught driving without a license I think in 2001 or 2002. He was given wreckless driving and leaving the scene of the accident (he didnt really do that, but thats a whole other story), and just recently he was in a small accident and charged with driving on a suspended license (he didnt know he was driving on a suspended license but the cop said he did) :curse:.
Anyway, this is all he has on his record. He has never filed a tax return. Most of the time he has been here, he has worked for cash.
Is there a separate waiver than the I601 he will need to file because of his record? And will there be a problem since he has never filed taxes? What should we do?
I was also curious that if for the Affidavit of Support, I have to send in my last three years tax returns even if I have to use a co-sponsor is that correct? If so, last year I claimed my niece as a dependent. She wasn't staying with me, but I did have her most of the time and support her. Anyways, would my income for that year have to include for her as well in the poverty guidelines?
I've also read that he could also have a letter from an employer stating they are willing to hire him full time and permanent, state how much he will be making, and have this on company letterhead and certified. Since I would only possibly qualify for one year on the affidavit of support, would that help it be sufficient enough?
Ok, i'm sorry this is soooo long but just one more question. I'm just asking for an opinion. Do you guys think we should file the I-129F or should we just get married here and do the I-130? Would that make it look better on us? (with that being asked, I might also add that my ex husband was also EWI and I legalized him through marriage with an I-130).
