View Full Version : GC holder wife want divorce, marriage is done outside the US, any legal ground?

Hi All,
I got my greencard by my job and then my wife got the greencard through me, after sometime, she wanted divorce from me, the marriage is done outside
the USA(in India) and marriage is not registered in USA, also divorce is also going to be done outside USA, my question is: does she has some legal ground here in USA against me, like can she
claim/demand something from me?

The only thing I can think of is that you signed an Affidavit of Support agreeing to support her for 40 quarters of work....so, as long as you are married, you must support her per the terms of the Affidavit. The fact that you were married outside the U.S. has no bearing as the marriage was accepted by USCIS as a valid marriage. Someone with more information will come along. I suggest you consult with an attorney as divorces can be sticky, then add USCIS as another element, ugh!

You must support her for 40 quarters regardless of whether you divorce, if you signed the Affidavit of Support. Divorce doesn't void that agreement, as stated in the instructions.

OMG....guess my husband is stuck with me. What if the wife leaves the country? Does the Affidavit of Support end?

You d not register a marriage in the US.
She can seek a divorce settlement and probably would best to do so in the US, m guess is that this would be much moe generous than India.
Any Affadavit issue only applies if she re-enters the US, I can not tell whether she would have issues doing this.

I know that a women in Mexico can get her husband in the US garnished for child support. I wonder if any other countries have that sort of setup?
