Hi, I just got a message from the consular officer that in order to prove my husband doesn't need a waiver they need proof of the final appeal of the BIA decision (removal due to denied political asylum case) to show that he doesn't have any unlawful presence. He checked with DHS and they have no record of the appeal! He is now requesting the A-file from Washington, which could take several months. I have a copy of the receipt from the circuit court, and a certificate of service saying that the appeal was sent to both the court and DHS, but no receipt from DHS - aaah!!! What can I do?
