View Full Version : Anyone approved in Lima for EWI? please help

Hi,
I'm thinking about starting this process but extremely worried, it seems that the approval rate in Lima is not so great. Does anyone know if you can move to Mexico and do it thru that consulate. I'm from Argentina and EWI married citizen and been in the states for 18 years I also have a son, but it seems like that wouldn't be enough. Any suggestions? Anything will be greatly appreaciated as my husband and I are trying to decide if it's worth it. Also is it THAT much harder to get the waiver in Lima if you entered without inspections?

Not really sure the answer to your Qs, but I think it's best to look into the Mx Guidelines whether or not if you're eligible to file there other than your consulate. I may be wrong here (as it's been awhile I saw the post about the same Q in the old site) but don't you hv to be in residence for a certain period? Hmmm...I'm not sure either myself...
I'm sure others will chime in soon about the eligibilities. Hang in there...

ok, i am not an expert on this but i have a waiver been in process at lima it is over 6 months now is not an EWI it is for an overstay,in your case i think it will be hard to get, lima waivers approval rate is low indeed and in your case you not only EWI but remained for 18 years if i understood correctly.having a child is a very strong case but today with immigration you never know and besides that depens who is reviewing your case...my prediction is that you have a very but very long road ahead if you feel strong enought take it remenber that parents are been deported having united states natural born childs, does that give you a picture???????.
think wise and get an advice from a well stablished immigration lawer i am pretty sure somebody in this forum will recomend one

Unfortunately you can't just move to another country to apply. If you wanted to apply through Mexico, you would need to establish legal residence in Mexico, meaning a legal permanent immigrant visa to Mexico (not a tourist or student or business visa) and thenlive there for a year before you apply.
I'm sorry. But don't give up- there have been approvals through Lima.

You definitely want to have a consulatation with a great immigration lawyer before you start this process knowing that since you EWI you will have to leave the US and do consular filing in Argentina and stay out of the US for 6 months to a year until you get an approval. If I were you I would sure want to make sure that I knew everything about my case before I left the US. So I would recommend a consult with Heather and Laurel. You want to know exactly what your options are. We have had several approvals through Lima. I don't know specifically any that EWI but that should not matter. Lima frowns more on fraud/misrepresentation. I have given you some links to get you started. Palinaurus is refiling through Argentina after a denial from Lima. There are not as many Lima filers on at the moment but there are some. The best thing you can do before you do anything is to put all of your facts in front of a trusted immigration lawyer to see if you are eligible. If you have hardships and are eligible and do send in a strong waiver you should be fine.

thanks to all...I tried to see if I could do a consul with visacentral but she mentioned she's not taking any consultations until December so I guess I'll wait another month, which is nothing in comparison to 18 years! Does anyone know if people that came with visa waivers can then just apply for adjustment in the US? It kills me how many people have done this and married USCs to get their residency and here I am in a loving marriage with a great family and can't do a thing about it....sorry for the vent, I had to let it out:blush:

Some people who came with visa waivers can adjust. It is impossible to compare cases as even the tiniest detail can change what your options are. It just makes sense to let the experts tell you where you stand legally.
No problem, vent all you want. Members here will support you through this. We all understand.
Immigration is not fair nor is it quick nor easy. It is what it is. The best thing you can do is figure out what your best option is and then just get to it. The sooner you begin the sooner you will be through.
The key thing is that you find out exactly what you are eligible for before you start. That way there are no surprises along the way that make you scramble for an option.
I would trust Laurel and Heather to put together a game plan and then work towards the goal. You can do it.
One other thing if I wanted to do a consult with Laurel and I would definitely, I would make sure I got her contracted as soon as she starts taking new cases. Her caseload seems to fill up quickly.

My husband is from Argentina, he overstayed 4 years. Our I-601 was denied and we are now waiting for a decision on our 2nd one. I have two daughters that I am putting through university, a very specialized 25 year technical career that cannot be practiced outside of a certain geographical region of the US, and to add to that I have frequent migraine and PTSD. I truly believe that going through the process is the right thing to do in order to correct past mistakes, yet apparently DHS does not demonstrate the same set of moral standards and sees fit to punish those who are trying to do things the right way.
In general I would be concerned about dealing with Lima.
I will post how things go when we receive the results of our 2nd waiver.

i agree with palinurus and pinkpig, even though lima is approving cases you must consider what kind of violations you were involved and how lima, wich will be the office handling your waiver sees them , the ones you have they.... lets say......dont easily chew.but at the end all this is a suposition..do not even move a finger without consulting with laurel or heather first .if you get to them they will give you a clear picture and better a clear option (if you have one) about your situation....as i said in one of my post, the road ahead is the longest you have ever seen BE PREPARED. i am not scaring you, but when persons are warnned the situations are more bearable.REMEMBER DO NOT MOVE WITHOUT CONSULTING FIRST WITH AN EXCELLENT LAWER

You have been here for 18 years? I believe that was well before the current Immigration and Nationality act went into effect. Definitely consult with Heather or Laurel or both. In the mean time, keep on going. It may be in your best interest to wait and see on what happens with Immigation Reform after the next election.
