View Full Version : Getting married on 11/07 and preparing for the road ahead
Hi!
I was hoping to get some info and help. I am getting married in NOV 07. My husband to be entered EWI when he was 16 and has been here since. Once we are married how soon should I send out the I-130. All the help and guidance will help.

I dont know how long everybody else waited but I sent our 1-130 a month after we were married.

We have been married 8 months and just filed. My lawyer said we could send it as soon as we were married, but I wasn't ready for my husband to leave for a year, but now with the pilot program you might as well do it about a month later. If you are going to change you name take the first month to do all that and then get started.

We waited just over a year after we were married before submitting our I130 - because we did some background checks on my husband first.
But, I agree with the previous posters...if you have everything documented, filled out, prepared before your wedding - there is no reason that you would need to wait to send in the papers.
The sooner you start - the sooner you can be finished!! ;)
BTW - congratulations on your upcoming wedding. That day will be here before you know it!! :p

Two months after our wedding, we mailed our I-130. Some members have also filed the 129(f) to speed up the process, but we did not take that route. Congratulations on your upcoming wedding!

hey jaan-
i'm getting married august 4th (aaah!) and i'm filing as soon as i can get official copies of the marriage certificate. i want to get the ball rolling so this can all be over with asap.
congrats on your wedding! we'll be more or less on the same timeline, so let's keep each other posted.

I filed the day I received a copy of the marriage certificate in the mail and got it translated (it was in French!!!!!!!!!!)

good luck with your wedding and just remember to enjoy your day. No matter what happens, take it all in and enjoy.
As for the petition, we filed only the I-130 a month after we married. Maybe a little more than that. But like a previoius poster you can also file the I-129f to speed up the process once you get receipt for your I-130. You can wait or you can go ahead and do it. It's entirely up to you. Thank you all for the replies! We are so excited about our wedding although the mother in laws are already going at each others necks. I don't know what is more scary "las suegras" or this process.
Question- Do all cases where there has been an EWI been denied after the I-130?
Hope I make sense.

Although the I-130 will be approved, the immigrant will be denied the visa at the consular appointment abroad, if he entered without inspection. He will be subject to the 10-year bar, if he's accrued more than 365 days of illegal presence. He will be told if he's eligible to file the waiver, which you will file on his behalf with the hardship letter and related documentation.
