Hello I have been serving in the military for 10 years, with two combat tours of Iraq, Me and my wife have been married for 7 of the 10 years, and have 3 us citizens boys together. I am a US Citizen myself, generations since the civil war.

All of her family is here legally, therefor she has no ties to Mexico anymore, no where to live and I dont speak spanish, she speaks both fluently. This is extreme hardship to us!

She was denied a green card back in 2003 during the extended amnesty period, but had employment for 1 year.

However, They offered her voluntary departure, but lawyer said if she went back and did the written statement then in a way she admits guilt to the charge, so confusing, my lawyer was from AILA thats why it cost me thousands in three different retainers.

I have transcript from DHS and she clearly said mexican citizen several times then they twisted it, can I dispute this for my lovely wife? She lives with me in the United states, she has been present in the united states since jul 1999.

What can I do to get it right?
do I have to wait the 10 years like they told me to reapply?
Why couldn't I get exercise of prosecutorial discretion from district director?
Is there any hope?

He said he had his hands tied, whats a pen stroke, lazy what good are they if they can't handle their job?

Im facing another deployment when I get back to the states from Korea.

My lawyer told me not to go to the media cause it could backfire, but that was in colorado, not an immigrant friendly state, whatever that means.

What if I die in my 3rd tour not knowing what would happen to my family.

Overall the INS officer were very nice to me and my family, they didnt take her away which they could of done. I was on my way to Iraq in 2003.
INS Officer had common sense! That why they should give power to them to grant waivers not politicians who never see the people.
