OK someone told me it is nice to have one so I made one and to sign it and explain what I am petitioning for so what do you think of this one...

Cover Sheet –

Contents for: I-130 Petition for Alien Relative application

This packet contains a I-130 Petition for Alien Relative for my husband, "husbands Name", who is a citizen of Mexico. Below is the contents of this package in order from front to back.


1. Check cliped to front of Application

2. I-130 Petition for Alien Relative

3. G-325A Applications for Petitioner "USC Wife's Name"

4. Passport type photo of "USC Wife's Name" in baggie attached to a sheet of paper (name and date on picture)

5. G-325A applications for alien relative "Husbands Name"

6. Passport type photo of "Husbands Name" in a baggie attached to a sheet of paper (name and date on picture)

7. Proof of US Citizenship - Copy of US birth certificate for "USC Wife's Name" (Maiden name XXXXX)

8. Proof of Marriage – Copy of Marriage License for "Husbands Name" and "USC Wife's Name"

9. Proof of Bona Fide Marriage between "Husbands Name" and "USC Wife's Name"
a. Notarized Affidavit of bona fide marriage from birth mother of "USC Wife's Name"
b. Photocopy of joint credit cards for both "Husbands Name" and "USC Wife's Name"

Angela -

Aren't you including a copy of your husbands birth certificate also? I did not see that mentioned above. Our lawyer prepared our documents in this order, just as an FYI:

cover letter
1. fee
2. passport photos of each of us
3. G28 (form introducing our lawyer)
4. I130 petition
5. all 8 G-325A's
6. my birth certificate
7. my husbands birth certificate
8. our marriage license
9. our son's birth certificate
10. evidence of joint marriage (she did not list all of the evidence individually, just stated it as 'evidence' and it included bills, bank statements, tax forms, insurance papers and photos of our lives together *with descriptions and dates for the photos)

Well I was going to include it, but people told me it is not needed for the I-130 cause you only need to prove that I am a USC and that we are married. I also had photo copies of pictures with captions and people said that was not needed either. Maybe I should just add that back in.

In my opinion, I would add them. Only for the simple fact that I think it is better to provide to much rather than too little. It would be a bummer for the USCIS to either deny, based on lack of proof - or to delay the approval by needing to request more information. (an RFE) Pictures are also a great way to show the realness of your relationship. Holiday pictures, vacations, your wedding, etc...

If you don't have his birth certificate - and you were told that it was ok to send it without - then don't hesitate to do so...but if you do have it - I guess it wouldn't hurt to send it along.

A copy of the birth certificate of the non US citizen is not a requirement at the petition stage, however there has been times in the past when a petitioner will receive an RFE for the non US citizens birth certificate. In fact CSC used to send an RFE for the beneficiary's birth certificate on a regular basis. It does no harm to send it if you have it, and it beats getting an RFE for it.
It is now also required to submit evidence of a bonafide marriage when you file the I-130. Never used to be the case, but it is now according to the instructions.

NOTE: In addition to the required documentation listed in 1)through 4) above, you should submit one or more of thefollowing types of documentation that may evidence that bonafides of your marriage:
1) Documentation showing joint ownership or property; or
2) A lease showing joint tenancy of a common residence; or
3) Documentation showing co-mingling of financial resources; or
4) Birth certificate(s) of child(ren) born to you, the petitioner, and your spouse together; or
5) Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship (Each affidavit must contain the full name and address, date and place of birth of the person makingthe affidavit, his or her relationship to the petitioner of beneficiary, if any, and complete information and details explaining how the person acquired his or her knowledge of your marriage); or
6) Any other relevant documentation to establish that there is an ongoing marital union.


Photographs don't really prove a bonafide marriage IMO, but there is no harm in sending them.

I have his birth certificate. We don't have a joint lease and I don't think we will be able to get one. I have two affidavits from my mother and friend.

I included only what was specifically asked for in the instructions. Can't remember everything exactly but it was the photos, a copy of our marriage license and my birth certificate. Didn't include my husband's BC or additional photos of us together, affidavits or anything else to provide evidence of a bonafide marriage. I figured if they wanted the extra paper they would ask for it specifically.

I know in older threads that have been lost there was talk of not sending more because it's just more for them to go through and could actually delay processing. I'd say, if you're really going to stress about not having put the extras in, you should save yourself the grief and just include everything you've got. If you think you'll be alright and not second-guess yourself (any more than we all normally do in this situation) then just give them what they ask for.

It does now ask for the proof of bona fide marriage stuff.
