Senator Levin has a name check amendment that is expected to be voted on soon. American Families United is encouraged that the problem is being recognized but also working to extend the language to provide not just a reporting to Congress but also a means for those 'stuck in name checks' more than 6 months to be able to gain better information and ultimately more timely resolution.

AFU and Legal Immigrant Association have joined in a coalition to promote this effort, Secure Check Alliance.org.

We have several people who are scheduling meetings or who have met in
most of the key districts for the upcoming conference, which could be
held any day now.

At this point, we are starting to move into a mode where we would like
people in these key districts simply to call in with a shorter message.

If you are in one of the key districts below, please send us a quick
email at stories@securecheck alliance. org and we will get back to you
with who you can contact specifically and what you can say to help us
gain momentum.

The key districts again are:

Dutch Ruppersberger, Maryland, district 2

Rodney Frelinghuysen, Ranking Member, New Jersey, district 11
John Culberson, Texas, district 7
Hal Rogers, Kentucky, district 5
Tom Latham, Iowa, district 4
Robert Aderholt, Alabama, district 4
Jerry Lewis, California, district 41

These calls really do make a difference when they are from people who
live in the district.

This means there are still bills that are being considered by Congress and the Senate which will help thousands of Americans and their spouses.

Was there a specific quesation?

It's something that impacts very few people on this board, you will need to explain what you are talking about.

Every one who gets a green card or who applies for Citizenship goes through a back ground check. As part of that process if they find a hit on your name the process comes to a hault until they verify that the hit on your name means something or not and in almost every case it means nothing.

Today, These name checks can take years to complete. The FBI doesnt see them as important (as the hits are almost always just do to duplicate/common names) and so what ever benifit your applying for gets held up. Often times you need to sue DHS in order to get them to move foward.

The odd thing about this is many of these people who get held up in these delays are already in the US. So from a security standpoint it doesnt make sense that the FBI takes years to validate if the applicant is a security risk if they are already in the US.

If your married to a perminant resident/green card holder you could end up in these days when you apply for Citizenship even if you didnt have this delay with your green card.

Is it a hit on your name if there is someone with a similar name? Or only if the person with the similar name/birthdate committed a major crime??

If a name is hit, it is because either ...

A. An exact match on some watch list and is wanted by the gov for something

or B. close enough to have to check it out further

From what I understand, people who apply for citizenship seem to have the most problems with name check delays.

Though some people going through the green card process (including the waivers) go through it too.

Almost all of the time, the name checks turn up nothing on the applicants. The government wait untill they get a 50 or 60 thousand lawsuits and then ram through their computer databases all the names to check in 30 to 60 days.

It slows down the legal process to come to the U.S. with either a GC or get citizenship. Everyone here is trying to do it the right way so you wont have anymore problems with immigration, and the name check delays are just one more burrecratic stumbling block nightmare for people to muddle through.

That's why AFU posted it here. We are trying to change the laws for the better because the process is totaly unfair to U.S. citizens and their foreign born spouses who want to live here.
