from what I read, letters are going out May-July so not everyone has gotten a letter yet.

Does it apply to folks who have never been legal or just those who had a visa and overstayed, etc?

I think you have to be immediately eligible for a visa. An overstay would make you inadmissible, so the DV lottery wouldn't work. :(

Also you can't enter the lottery if you are from countries that already send over 50,000 immigrants here per year- Mexico included.

You do have to eligible to adjust your status so being illegal, you can't enter the DV.
SA countries not eligible last year:
Countries in this region whose natives are not eligible for this year's diversity program:
Brazil, Colombia, Dominican Republic, Ecuador, El Salvador, Guatemala, Haiti, Jamaica, Mexico, and Peru.
As soon as we have info on the DV2010, we'll post it.

Can anyone correct me on this but I thought that once a I-130 application was pending or approved it was possible to apply for the lottery visa?

The reason I think it's no is because of this:
"MAY SELECTEES ADJUST THEIR STATUS WITH USCIS?
Yes, provided they are otherwise eligible to adjust status under the terms of Section 245 of the INA, selected individuals who are physically present in the United States may apply to the USCIS for adjustment of status to permanent resident. Applicants must ensure that USCIS can complete action on their cases, including processing of any overseas derivatives, before September 30, 2010, since on that date registrations for the DV-2010 program expire. No visa numbers for the DV-2010 program will be available after midnight EST on September 30, 2010 under any circumstances."
But I would love to have confirmation or correction on this point.
