View Full Version : Help needed - I212 waiver

Please help I need advice. I was removed from the U.S. in 2002 for an Embezzlement conviction which is classified as an aggravated felony. I wanted to visit my daughter who is a U.S. citizen and applied for a visitors visa and was denied because of my record. I found out I may not be able to go back even to visit the U.S. I don't have plans of going back to live in the U.S. but just to visit my daughter and now my grand daughter. After doing some research, I came about the waivers. How do I know if I qualify for the I212 waiver and do I have to file a 601 also. I tried to hire a lawyer but they just took my money and said there's no way I can go back to the States even to visit. Is this true? I travelled to other countries without a problem and all I wanted to do was just to visit. I would appreciate advise from people who have experienced with I212 waivers and how to do it. If there's any reliable honest lawyers I can contact also. Thank you.

If you are trying to enter just for a visit then you would want to file and I-192. There are specific instructions on the form, but you have to prove that you do not intend to immigrate and have a clear cut reason for the visit. It's usually in addition to your visiting visa application.

There are a few threads about this form on here if you comb through...I will try to look when I get a little more time. Fee is $545.

If you needed the 601, I think it is only available for immigrant visas and you have to prove that it would cause "Extreme Hardship" to the qualifying relative. I'm not sure if Embezzlement is a "CIMT" though.

According to this link, you would be ineligible to receive a visa and need the I601 "Hardship Waiver." I would consult an attorney if your only intention is to visit, but I'm not sure if there is anything they can do.

Thanks for the response. I read the link and I got disheartened. Does its mean that I really do not have any chance of visiting the US? I found a website that seems to be promising Bretz & Coven, LLP New York. Now I am getting confused if I should consult with them or there really is no way for me to get a any kind of waiver. So it means I am for life banned from entering the U.S. Anybody who has a similar experience please I need advice if a lawyer could help me or it would be a waste of money. anybody knows of a case like mine that was successful. jesuslovesyou please help any advice please

isobel, I don't know if it would help at this point, but an attorney that frequents this site, (and specializes in I-601 waivers) Laurel Scott, hosts a free weekly chat on her website, www.visacentral.net. It may be worth asking your question to her on one of her chats if you are able to attend.

You need to research on 212 D(3) waivers for non immigrant. This covers almost all type of inadmissiblities. This waiver becomes a lot easier if you country qualified for visa waiver program.

Sorry guys i havent loged in for long time .

isobel you cnot enter USA with just 212 and 601 and they wont entertain both the waivers for visit visa and you will have a hardtime proving non imiigrant intent.

this is waht you can do ..apply for visit visa and if consulate gets convinced you qualify for visit visa they recomend you a waiver which is 212(d)(3) if you are from canada you can apply for i-192 .

for all the above you need all the police records everything in detail . you letter explaining what transpired and apology ..evidence showing rehabilation good person responsible etc etc ..and your reason for visit ..all basically depends how you can show that you are a good person and not a threat to us socity

Hi, again I don't know if you remember my case, but I need to ask you some questions. Did you file your 212 (d) from Canada, if so, do you mind if I ask you if you are a Canadian citizen ? And can you please explain to me the process? You can send a PM if you wish, I will really appreciated your help.I know I have to file in Cd. Juarez but I don't know if I'm going to need to make appt. info-pass
or If I just go to the consulate, I been trying to call to the info # but they don't pick up. Thanks!

yes i did .. you can apply in cdj look into sticky ..for info on 212(d)(3)

you dont need y forms or special applications or pointments you attend your niv interview like anybody else after your interview they determine that you have ineleigibility and you cant recive visa

by law

1. they can request for waiver from dhs

or

2. if yoi request they have to send it to dhs

if dhs agrees then they garnt you visa it takes 4 to 6 weeks in my case i have to fo another interview as i didnt submit any support documentation and relied solely on consular ecomendation so i am planing to go this month have been busy lately hopefully it helps now
