Hello everyone:

I posted some questions today but I guess I didn't really ask what I want to know, or didn't know how to address it. Well my fiancee came to the us illegaly on August 1999 and was arrested for drug-related crime on June 2000 and released on October 2006 with deportation and a life ban stating he is inadmissible because of an aggravated felony. I met him back in 2004 and engaged since last October, I am now pregnant (7 mos)with his child and need to file for his admission, but as you can see it really sounds hard. Please let me know if there is a waiver for his felony. If he qualifies for a waiver, I have good evidence of hardship I can submit due to the fact that my unborn baby was diagnosed with X-Linked HyperIGM and will be needing special treatment and unfortunately a bone marrow transplant to be cured.

Please help me!!! I am so worried... and stressed!!

I am so sorry to hear about your baby. It must be very stressful for you right now. Good luck and try not to stress too much because you know it is not good for the baby.

Thank you for your response, yes I feel very stressed and I try to calm down for my baby but I feel very worried not knowing what's going to happen.

I hope someone who knows about aggravated felonies would answer my question soon!!

Happy Holloween!!

Izzie - I'll ask Laurel next week, but can you clarify what the crime was? Was he in prison from 2000 to 2006? Or what was that about?

I would actually recommend you spend the $125 to consult with Laurel, as she will at least be able to give you some basic information about your waiver options.

There are waivers available for some crimes, but I think felonies are a big problem. He might be banned for life...

Thank you for your responses laurafern11,yes he was in prison from 2000 to 2006 and his felony is the following:

21:841(a)(1) & 846 CONSPIRACY TO MANUFACTURE, DISTRIBUTE AND POSSESS WITH THE INTENT TO DISTRIBUTE A CONTROLLED SUBSTANCE

Thank you very much for asking her for me... I will also try to log in the chat room if I can.

Hmm... Izzie - that doesn't sound good at all. I really think you should consult with Laurel. Check out her site, visacentral.net. You can wait until next Wednesday and ask at the chat as well.

Hi Izzie - I asked your question in the chat a few minutes before you were there I think. In any case, she said the same thing. The only waivable drug offense is a single marijuana possession. It sounds like there will never be a waiver available for your fiance, your hardship doesn't matter whatsoever. Sorry...
