I'm helping my brother-in-law with his i-130, I was wondering if he(the immigrant) needs to submit his birth certificate? I read the form several times and don't see them requesting but I remember submiting one. Thanks

No th immigrant does not have to send their BC at the time of the I130 being sunmitted. He will however have send an original certified copy of his later in the process when he has to submit the DS-230. The pet. does have to send a copy of their BC though.

Although it may not be required - we filed the I130 with the help of a lawyer and submitted both my husband (the immigrant) and my birth certificates. As well as our sons....

Guess my point is - that it probably wouldn't help or hurt if you did submit it.
