HI,

Just wanted to let you guys know that my I-212 was approved last friday and they are forwarding the information to the embassy in Stockholm. We are good to go. First we will go on a trip for 3 months before heading to the US.

I would like to say thanks for all the help you guys have given me :thumbup:

Well, me specifying my supporting documents won't probably help anyone since it was such a special case.

All I did was to provide the following to prove that I was not living in the US at the time of deportation:

1. Birth certificate for our daugther, proving that she was born abroad
2. Tax returns proving that I filed taxes and earned an income in the country I am currently living in.
3. Copy of all the pages from my passport
4. Letter explaining my situation.

That was it.

Hi Hinke,
I dis agree, the specifics of your case would help others understand the 212 process a little clearer, because some are under the assumption that all 212's need to be exactly similar to a 601 application. Your input into this thread would provide another perspective on the 212 waiver process. Can you please answer the following, and with your permission, I will copy and paste your response onto the supporting document thread.

Did you need only a 212 waiver?
What were the details of your case that caused you to need a 212 waiver?

Hi,

I only needed to file the I-212 since I did not overstay. I had already left the US when the deportation happened. I had failed to notify the USCIS that I left the US in 2000 after already received my Conditional Green Card.

I had only had my Conditional Green Card for 5 months when we decided to move away from the US. I failed to notify them about this. When I did not renew or adjust the status of my Conditional Green Card they (not sure who) sent me a letter to remind me (I never received this letter since we did not live at that address anymore). When I did not adjust the status they sent me a letter to appear infront of an immigration judge in Cleveland. I never saw this letter either. When I did not appear in court the warrant for my deportation was issued. I had in 2003 abandoned my Conditional Green Card, I filed a I-407 at the embassy....but apparently the embassy does not give this information to the USCIS...

During this time I was able to travel (vacation) in and out of the US without any problems. The reason for this is that they misspelled my name on my last Conditional Green Card + I had to renew my old passport so I got a new passport number....

Now when we wanted to move back to the US I was questioned heavily at the final interview at the embassy on my whereabouts at specific dates. The consular finally realized that I did not know why he asked me all these questions and was able to unravel the whole situation. He said it would take him a few weeks to fix, but 2 weeks after the interview we got a letter from the embassy that said we needed to file the I-212 at the Cleveland office. First they said I needed a laywer....but then I only needed the I-212. We then new this was not good at all. We sent in the application with supporting documents:

1. Birth certificate for our daugther, proving that she was born abroad
2. Tax returns proving that I filed taxes and earned an income in the country I am currently living in.
3. Copy of all the pages from my passport
4. Letter explaining my situation.

We did not hear anything from the Cleveland office except that they received the application and that they cashed the check.

I was not able to handle this situation so well, and felt really stressed etc.

cindy101 on this forum, then told me to contact the senator of Ohio and maybe they would be able to help me.

I contacted the senator on a Wednesday, Friday, same week my application was approved.

I now have my I-551 (I think that is the number) in my passport + a huge envelope that I am not allowed to open. My visa will expire in may of 2008 and we will fly from here on April 10th 2008. First we are going on a 3 month long trip that we think we deserve after this ordeal.

Well, hopefully this will help someone else in their situation.
