Does anybody know the processing times for an adjustment of status under 245i through employment??? My sister-in-law has been dealing with a lawyer to adjust status through employment under section 245i. The application was sent and received April 2, 2001. Should it still be pending or should she have heard something by now??? Her lawyer just keeps telling her the same thing all the time, it is still pending.....

You should check the current visa bulletin and priority dates.

Depending on the job type/skill level. Most employment based visas for Mexicans show as current meaning visas are available and up to date with no waiting (aside from one category called Other Workers). At the same time, the site also indicates

"Effective Monday July 2, 2007 there will be no further authorizations in response to requests for Employment-based preference cases. All numbers available to these categories under the FY-2007 annual numerical limitation have been made available.

Employment preference numbers will once again be available to these chargeability areas beginning October 1, 2007, under the FY-2008 annual numerical limitation". I would get the lawyer to explain a few things -- exactly what is her filing cateogory called i.e. employment based 1st, 2nd, 3rd, etc. and exactly what is the current priority date for her category. If that jives with the visa bulletin, it sounds legit. If it doesn't, dump him.

I think I am going to go with her to pay a visit the lawyer. It seems like it is really taking a long time and she may need someone with a stronger voice with at least some immigration knowledge to get any answers.
